The Ne<strong>the</strong>rl<strong>and</strong>s<br />

It should be noted that <strong>the</strong> <strong>cultural</strong> objects covered by a general open licence must be<br />

<strong>export</strong>ed <strong>to</strong> one address <strong>and</strong> returned from <strong>the</strong>re. This type <strong>of</strong> licence may <strong>the</strong>refore not<br />

be suitable for a <strong>to</strong>uring exhibition with multiple venues in different countries.<br />

I am a visual artist. Do I need a licence <strong>to</strong> <strong>export</strong> my own work?<br />

No. Art work which belongs <strong>to</strong> “<strong>the</strong> origina<strong>to</strong>r” (i.e. <strong>the</strong> artist who created it) does not require<br />

an <strong>export</strong> licence under <strong>the</strong> EU <strong>export</strong> licence legislation, whatever its age or value.<br />

Therefore you do not need a licence <strong>to</strong> <strong>export</strong> your own work if you still own it yourself.<br />

I am a musician. Do I need <strong>to</strong> know about <strong>export</strong> regulations if I am travelling with my<br />

instrument?<br />

Yes. Any musician who wishes <strong>to</strong> travel outside <strong>the</strong> European Union with a musical instrument<br />

which is over a certain age <strong>and</strong> value must obtain an EU <strong>export</strong> licence. This applies<br />

whe<strong>the</strong>r <strong>the</strong> <strong>export</strong> is temporary, e.g. for a concert <strong>to</strong>ur, or permanent.<br />

A pr<strong>of</strong>essional musician who travels frequently with <strong>the</strong>ir musical instrument <strong>to</strong> countries outside<br />

<strong>the</strong> EU for <strong>the</strong>ir work can apply for a specific open licence. This will enable <strong>the</strong>m <strong>to</strong> take<br />

<strong>the</strong>ir instrument <strong>to</strong> countries outside <strong>the</strong> EU for pr<strong>of</strong>essional purposes on repeated, short-term,<br />

temporary occasions. The applicant must give all necessary guarantees that <strong>the</strong> instrument will<br />

be returned <strong>to</strong> <strong>the</strong> Ne<strong>the</strong>rl<strong>and</strong>s in perfect condition. This type <strong>of</strong> licence is valid for three years.<br />

I am a <strong>to</strong>urist visiting <strong>the</strong> Ne<strong>the</strong>rl<strong>and</strong>s. If I buy a work <strong>of</strong> art, how do I take it home with me?<br />

The <strong>export</strong> regulations apply <strong>to</strong> anyone who wants <strong>to</strong> take <strong>cultural</strong> <strong>goods</strong> <strong>of</strong> a certain age<br />

<strong>and</strong> value from <strong>the</strong> Ne<strong>the</strong>rl<strong>and</strong>s <strong>to</strong> <strong>Russia</strong> (or <strong>to</strong> ano<strong>the</strong>r country). You must go through <strong>the</strong><br />

application process as described in order for <strong>the</strong> <strong>goods</strong> <strong>to</strong> be cleared for <strong>export</strong>.<br />

If you have bought <strong>the</strong> art work, antique, furniture or o<strong>the</strong>r <strong>cultural</strong> <strong>goods</strong> from a reputable<br />

art or antique dealer, ask <strong>the</strong>ir advice on how <strong>to</strong> apply for <strong>the</strong> <strong>export</strong> licence.<br />

While <strong>the</strong> application is being processed, <strong>the</strong> <strong>goods</strong> must remain in <strong>the</strong> Ne<strong>the</strong>rl<strong>and</strong>s until <strong>the</strong><br />

licence has been granted. You may <strong>the</strong>refore have <strong>to</strong> arrange for transportation at a later date.<br />

If you are in any doubt, check <strong>the</strong> age <strong>and</strong> value <strong>of</strong> <strong>the</strong> <strong>cultural</strong> <strong>goods</strong>. This determines<br />

whe<strong>the</strong>r an <strong>export</strong> licence is required. In general, <strong>the</strong> <strong>export</strong> controls apply <strong>to</strong> <strong>cultural</strong><br />

<strong>goods</strong> which are over 50 years old <strong>and</strong> <strong>of</strong> a certain value.<br />

Is <strong>the</strong>re a fee for an <strong>export</strong> licence?<br />

No – <strong>the</strong>re is no fee for <strong>the</strong> licence.<br />

Does <strong>the</strong> <strong>cultural</strong> object need <strong>to</strong> be valued? If so, who will do this?<br />
