I am a <strong>to</strong>urist visiting Hungary. If I buy a work <strong>of</strong> art, how do I take it home with me?<br />

If you have purchased an object that is over 50 years old, you must apply <strong>to</strong> <strong>the</strong> National<br />

Office <strong>of</strong> Cultural Heritage for an <strong>export</strong> licence.<br />

If you are not sure whe<strong>the</strong>r it has <strong>the</strong> status <strong>of</strong> a <strong>cultural</strong> good, or if it is under that age threshold,<br />

you are none<strong>the</strong>less advised <strong>to</strong> contact <strong>the</strong>m because <strong>the</strong>y can provide you with information<br />

on <strong>the</strong> status <strong>of</strong> your object (whe<strong>the</strong>r it is subject <strong>to</strong> licensing or exempt from it). In addition,<br />

<strong>the</strong>y can provide you a certificate stating that <strong>the</strong> object is not subject <strong>to</strong> licensing.<br />

Does <strong>the</strong> <strong>cultural</strong> object need <strong>to</strong> be valued? If so, who will do this?<br />

Yes, <strong>the</strong> National Office <strong>of</strong> Cultural Heritage will always request <strong>the</strong> opinion <strong>of</strong> an expert<br />

before making a decision on issuing <strong>the</strong> <strong>export</strong> licence.<br />

If an <strong>export</strong> licence is refused, can I appeal? How do I do that?<br />

Yes. The <strong>export</strong> licensing procedure is subject <strong>to</strong> <strong>the</strong> general rules <strong>of</strong> public administration<br />

<strong>and</strong> procedures. Therefore you can lodge an appeal with <strong>the</strong> authorities against <strong>the</strong> refusal<br />

<strong>to</strong> issue a licence, or <strong>the</strong> declaration <strong>of</strong> protection <strong>of</strong> <strong>the</strong> good (which au<strong>to</strong>matically leads<br />

<strong>to</strong> a refusal <strong>of</strong> <strong>the</strong> licence). You can also appeal <strong>to</strong> Court.<br />

Which Cus<strong>to</strong>ms authorities are empowered <strong>to</strong> deal with <strong>the</strong> <strong>export</strong> <strong>of</strong> <strong>cultural</strong> <strong>goods</strong>?<br />

What o<strong>the</strong>r paperwork do I need <strong>to</strong> <strong>export</strong> a <strong>cultural</strong> object?<br />

You have <strong>to</strong> present <strong>the</strong> <strong>export</strong> licence <strong>to</strong>ge<strong>the</strong>r with <strong>the</strong> <strong>export</strong> declaration.<br />

What are <strong>the</strong> penalties if I do something wrong?<br />

The <strong>export</strong> <strong>of</strong> a <strong>cultural</strong> good without a licence, as well as <strong>import</strong> in violation <strong>of</strong> <strong>import</strong><br />

regulations are both <strong>of</strong>fences in <strong>the</strong> sense <strong>of</strong> <strong>the</strong> Hungarian Criminal Code <strong>and</strong> can lead<br />

<strong>to</strong> imprisonment sentences.<br />

Violations <strong>of</strong> Act No. 64 can also be punished with a heritage protection fine imposed by<br />

<strong>the</strong> National Office <strong>of</strong> Cultural Heritage.<br />

Are <strong>the</strong>re any special <strong>export</strong> restrictions on certain objects or o<strong>the</strong>r considerations I should<br />

know about?<br />

Act No. 64 establishes categories <strong>of</strong> <strong>goods</strong> that are under special protection (e.g. archaeological<br />

finds, movable accessories <strong>of</strong> monuments, objects <strong>of</strong> public collections, etc.).<br />

The National Office <strong>of</strong> Cultural Heritage can also declare <strong>the</strong> protection <strong>of</strong> o<strong>the</strong>r <strong>cultural</strong><br />
