Chapter 3: European Union Member States<br />

Denmark<br />

Permission must be obtained in order <strong>to</strong> <strong>export</strong>:<br />

• Cultural objects from <strong>the</strong> period before 1660<br />

• Cultural objects older than a 100 years <strong>and</strong> valued at DKK 100,000 or more<br />

• Pho<strong>to</strong>graphs (regardless <strong>of</strong> age) if <strong>the</strong>y have a value <strong>of</strong> DKK 30,000 or more<br />

In exceptional cases <strong>the</strong> Minister for Cultural Affairs can decide that <strong>the</strong> Act is also applicable<br />

<strong>to</strong> o<strong>the</strong>r objects <strong>of</strong> <strong>cultural</strong> interest.<br />

Under EU legislation, <strong>cultural</strong> <strong>goods</strong> which fall under certain categories, values <strong>and</strong> age<br />

(explained in more detail in Chapter 2) require an EU <strong>export</strong> licence for <strong>export</strong> <strong>to</strong> countries<br />

outside <strong>the</strong> European Union.<br />

Are <strong>the</strong>re different types <strong>of</strong> licence? What type <strong>of</strong> licence do I need?<br />

There are two different types <strong>of</strong> licence:<br />

• The <strong>export</strong> licence (under Danish national legislation)<br />

• The EU <strong>export</strong> licence (under EU legislation for <strong>export</strong> <strong>to</strong> countries outside <strong>the</strong> EU)<br />

Within this, <strong>the</strong>re are two modalities: definitive <strong>and</strong> temporary <strong>export</strong>, each <strong>of</strong> which has<br />

a separate licence.<br />

What are my first steps? How do I plan this process <strong>and</strong> how long might it take?<br />

The Commission on Export <strong>of</strong> Cultural Assets has two forms for <strong>export</strong> licence applications.<br />

One is for <strong>the</strong> <strong>export</strong> <strong>of</strong> <strong>goods</strong> over 100 years old <strong>and</strong> valued at more than DKK 100,000 which<br />

<strong>the</strong> owner wishes <strong>to</strong> take out <strong>of</strong> Denmark <strong>to</strong> ano<strong>the</strong>r European country. The o<strong>the</strong>r is a European<br />

application form which must be used if <strong>the</strong> <strong>goods</strong> are <strong>to</strong> be <strong>export</strong>ed outside <strong>the</strong> EU.<br />

The EU form can be obtained by contacting <strong>the</strong> Secretariat <strong>of</strong> <strong>the</strong> Commission on Export<br />

<strong>of</strong> Cultural Assets.<br />

The Danish form can be downloaded from <strong>the</strong> website. It is <strong>import</strong>ant that all requested<br />

information on <strong>the</strong> form is forwarded along with two pictures <strong>of</strong> <strong>the</strong> asset <strong>and</strong> a power <strong>of</strong><br />

at<strong>to</strong>rney if you apply on behalf <strong>of</strong> somebody else. The Commission on Export <strong>of</strong> Cultural<br />

Assets does not consider <strong>the</strong> application until all <strong>the</strong> requested information is submitted.<br />

An application for an <strong>export</strong> licence will normally be processed within one month. If, on special<br />

grounds, <strong>the</strong> processing <strong>of</strong> any application cannot be completed within this period, <strong>the</strong><br />

Commission will notify <strong>the</strong> applicant <strong>and</strong> tell <strong>the</strong>m when <strong>the</strong>y expect <strong>to</strong> reach a decision.<br />

Once it has been granted, an <strong>export</strong> licence is valid for five years.<br />

How do I find out if <strong>the</strong> art object I want <strong>to</strong> <strong>export</strong> is <strong>of</strong> national significance? Is <strong>the</strong>re a Public<br />

Inven<strong>to</strong>ry <strong>of</strong> <strong>cultural</strong> <strong>goods</strong> <strong>of</strong> special interest or <strong>import</strong>ance?<br />

There is no public inven<strong>to</strong>ry. Each application is considered individually. Before a licence<br />
