Chapter 3: European Union Member States<br />
Are <strong>the</strong>re different types <strong>of</strong> licence? What type <strong>of</strong> licence do I need?<br />
If you are <strong>export</strong>ing a <strong>cultural</strong> good from Slovakia out <strong>of</strong> <strong>the</strong> EU, you need <strong>the</strong> EU <strong>export</strong><br />
licence, issued by <strong>the</strong> designated Ministry. Export can be ei<strong>the</strong>r permanent or temporary.<br />
What are my first steps? How do I plan this process <strong>and</strong> how long might it take?<br />
In Slovakia a st<strong>and</strong>ard form (European Community Cultural Goods Application) is used for<br />
applications for <strong>the</strong> <strong>export</strong> <strong>of</strong> objects <strong>of</strong> a <strong>cultural</strong> nature outside <strong>the</strong> Member States <strong>of</strong> <strong>the</strong><br />
EU in accordance with EU legislation. This form is published on <strong>the</strong> website <strong>of</strong> <strong>the</strong> Ministry<br />
<strong>of</strong> Culture: http://www.culture.gov.sk/files/files/pamiatky/kt.pdf<br />
Toge<strong>the</strong>r with <strong>the</strong> application you must present <strong>the</strong> following:<br />
• All relevant information on <strong>the</strong> object or objects, <strong>the</strong>ir legal status, etc.<br />
• Pho<strong>to</strong>graphs<br />
The Ministry may request <strong>the</strong> physical presentation <strong>of</strong> <strong>the</strong> object.<br />
The licence can be denied if <strong>the</strong> <strong>export</strong> <strong>of</strong> <strong>the</strong> specific object is banned or restricted under<br />
Slovak national heritage legislation.<br />
It takes varying lengths <strong>of</strong> time <strong>to</strong> issue a licence depending upon <strong>the</strong> kind <strong>of</strong> object <strong>and</strong><br />
<strong>the</strong> type <strong>of</strong> <strong>export</strong>. According <strong>to</strong> Act No. 115/1998 Coll:<br />
• For permanent <strong>export</strong> through exchange, <strong>the</strong> Ministry <strong>of</strong> Culture shall decide within 30<br />
days from <strong>the</strong> date <strong>the</strong> application is received.<br />
• For <strong>the</strong> permanent <strong>export</strong> <strong>of</strong> an object which is not kept in any museum or gallery, <strong>the</strong><br />
Ministry <strong>of</strong> Culture shall decide within 60 days from <strong>the</strong> date <strong>the</strong> application is received.<br />
• For <strong>the</strong> temporary <strong>export</strong> <strong>of</strong> a <strong>cultural</strong> monument, <strong>the</strong> deadlines are set out in Act<br />
No. 71/1967 Coll. on administrative proceedings (Administrative Code): within 30 days<br />
from <strong>the</strong> date <strong>the</strong> application is received or, in more serious cases, within 60 days from<br />
<strong>the</strong> date <strong>of</strong> receipt <strong>of</strong> application.<br />
How do I find if <strong>the</strong> art object I want <strong>to</strong> <strong>export</strong> is <strong>of</strong> national significance? Is <strong>the</strong>re a Public<br />
Registry <strong>of</strong> <strong>cultural</strong> <strong>goods</strong> <strong>of</strong> special interest or <strong>import</strong>ance?<br />
There is no such source <strong>of</strong> information. The Ministry <strong>of</strong> Interior keeps a database <strong>of</strong> s<strong>to</strong>len<br />
works <strong>of</strong> art.<br />
Are <strong>the</strong>re any exemptions for particular <strong>goods</strong>?<br />
No.<br />
Do museums <strong>and</strong> galleries need licences for temporary <strong>export</strong>s (e.g. a <strong>to</strong>uring exhibition)? Do<br />
non-pr<strong>of</strong>it organisations need <strong>export</strong> licences?<br />
In case <strong>of</strong> <strong>the</strong> temporary <strong>export</strong> <strong>of</strong> collection objects, <strong>the</strong> application is submitted <strong>to</strong> <strong>the</strong><br />
