Chapter 3: European Union Member States<br />

If you have bought <strong>the</strong> art work, antique, furniture or o<strong>the</strong>r <strong>cultural</strong> <strong>goods</strong> from a reputable<br />

art or antique dealer, ask <strong>the</strong>ir advice on how <strong>to</strong> apply.<br />

Since <strong>the</strong> application process can take some weeks or months, you should note that <strong>the</strong><br />

<strong>goods</strong> must remain in <strong>the</strong> Czech Republic until <strong>the</strong> Certificate <strong>and</strong> <strong>export</strong> licence have<br />

been granted. You may <strong>the</strong>refore have <strong>to</strong> arrange for transportation at a later date.<br />

Is <strong>the</strong>re a fee for an <strong>export</strong> licence?<br />

Yes – <strong>the</strong>re is a fee <strong>of</strong> CZK 500 for <strong>the</strong> Certificate <strong>of</strong> <strong>export</strong>. There is no fee for <strong>the</strong> EU<br />

<strong>export</strong> licence.<br />

There are no duties or taxes <strong>to</strong> be paid at <strong>the</strong> point <strong>of</strong> <strong>export</strong> from <strong>the</strong> Czech Republic.<br />

Does <strong>the</strong> <strong>cultural</strong> object need <strong>to</strong> be valued? If so, who will do this?<br />

No expertise is required although, under <strong>the</strong> law, <strong>the</strong> owner is obliged <strong>to</strong> enable examination<br />

<strong>of</strong> <strong>the</strong> object <strong>of</strong> <strong>cultural</strong> value. Objects <strong>of</strong> national <strong>import</strong>ance are listed in <strong>the</strong> Annex<br />

<strong>to</strong> Act No. 71/1994 or in <strong>the</strong> Annex <strong>to</strong> Act No. 214/2002. Collection objects which are part<br />

<strong>of</strong> a museum collection are recorded in <strong>the</strong> Central Registry <strong>of</strong> Collections.<br />

Can I appeal against <strong>the</strong> valuation? If so, how do I do this?<br />

Appeal is only allowed in cases <strong>of</strong> imposition <strong>of</strong> penalties for breaching any <strong>of</strong> <strong>the</strong><br />

legislation.<br />

If an <strong>export</strong> licence is refused, can I appeal? How do I do that?<br />

If <strong>the</strong> Ministry <strong>of</strong> Culture decides not <strong>to</strong> issue a Certificate <strong>of</strong> <strong>export</strong> it will start proceedings<br />

<strong>to</strong> declare that <strong>the</strong> <strong>cultural</strong> <strong>goods</strong> are <strong>of</strong> national <strong>import</strong>ance. You can <strong>the</strong>n appeal.<br />

If <strong>the</strong> Ministry <strong>of</strong> Culture decides not <strong>to</strong> issue a licence according <strong>to</strong> <strong>the</strong> EU legislation, it<br />

shall issue a decision <strong>and</strong> an appeal is permitted.<br />

EU <strong>export</strong> licences cannot be refused if <strong>the</strong> application is accompanied by a Certificate <strong>of</strong><br />

<strong>export</strong> or a Permit <strong>of</strong> <strong>export</strong>.<br />

Which Cus<strong>to</strong>ms authorities are empowered <strong>to</strong> deal with <strong>the</strong> <strong>export</strong> <strong>of</strong> <strong>cultural</strong> <strong>goods</strong>?<br />

All Czech cus<strong>to</strong>ms <strong>of</strong>fices can deal with <strong>the</strong> <strong>export</strong> <strong>of</strong> <strong>cultural</strong> <strong>goods</strong>.<br />

What o<strong>the</strong>r paperwork do I need <strong>to</strong> <strong>export</strong> a <strong>cultural</strong> object?<br />

When you leave <strong>the</strong> Czech Republic you must show one <strong>of</strong> <strong>the</strong> following:<br />

• Certificate <strong>of</strong> <strong>export</strong> (under Act No. 71/1994)<br />

• Permit <strong>of</strong> <strong>export</strong> (under Act No. 122/2000)<br />
