Do I need an <strong>export</strong> licence?<br />

If <strong>the</strong> <strong>cultural</strong> <strong>goods</strong> you want <strong>to</strong> <strong>export</strong> are<br />

covered by <strong>the</strong> EU regulations <strong>and</strong>/or <strong>the</strong><br />

Italian Code, you will need an <strong>export</strong> licence.<br />

If <strong>the</strong> <strong>goods</strong> fall under both legislations, you<br />

will need two licences. The Italian licence is<br />

called a Certificate or Authorisation.<br />

The <strong>cultural</strong> <strong>goods</strong> covered by <strong>the</strong> Italian Code<br />

(<strong>export</strong> is forbidden or restricted) include:<br />

• Any kind <strong>of</strong> artistic, his<strong>to</strong>rical,<br />

archaeological or anthropological object<br />

over 50 years old<br />

• Any kind <strong>of</strong> artistic, his<strong>to</strong>rical,<br />

archaeological or anthropological<br />

object belonging <strong>to</strong> museums, galleries<br />

<strong>and</strong> o<strong>the</strong>r public institutions<br />

• Pho<strong>to</strong>graphic <strong>and</strong> cinema<strong>to</strong>graphic<br />

material over 25 years old<br />

• Archives <strong>and</strong> book collections<br />

• Any <strong>goods</strong> <strong>of</strong> great his<strong>to</strong>ric <strong>import</strong>ance<br />

(political, military, his<strong>to</strong>ry <strong>of</strong> art, literature,<br />

culture etc.)<br />

• Works <strong>of</strong> art created by an artist who is<br />

deceased<br />

For works by an artist who is deceased,<br />

<strong>the</strong>re are specific regulations under <strong>the</strong><br />

Italian Code which are explained in more<br />

detail below.<br />

Are <strong>the</strong>re different types <strong>of</strong> licence? What<br />

type <strong>of</strong> licence do I need?<br />

Arnaldo Pomodoro,<br />

“Sfera con Perforazione”.<br />

Pomodoro’s work was shown in a group<br />

exhibition at <strong>the</strong> Manege in Moscow in 2006<br />

on <strong>the</strong> <strong>the</strong>me <strong>of</strong> ‘Myth <strong>and</strong> Speed’. In 1991<br />

his “Disco Solare”, a gift from <strong>the</strong> Italian<br />

Prime Minister's Offi ce <strong>to</strong> <strong>the</strong> Soviet Union,<br />

was installed in front <strong>of</strong> <strong>the</strong> Youth Building in<br />

Moscow. The sculpture can now be found<br />

in <strong>the</strong> courtyard <strong>of</strong> <strong>the</strong> Moscow Museum <strong>of</strong><br />

Modern Art.<br />

If <strong>the</strong> <strong>goods</strong> you want <strong>to</strong> <strong>export</strong> are covered<br />

by <strong>the</strong> Italian Code, this means that <strong>the</strong>ir<br />

circulation outside <strong>the</strong> country is restricted.<br />

You will <strong>the</strong>refore need a Certificate or Authorisation<br />

<strong>of</strong> Circulation (ei<strong>the</strong>r Temporary<br />

or Free Circulation) in order <strong>to</strong> take <strong>the</strong>m<br />

out <strong>of</strong> Italy. A Certificate <strong>of</strong> Temporary Circulation<br />

is valid for a limited period <strong>of</strong> time<br />

<strong>and</strong> <strong>the</strong> <strong>goods</strong> must be returned <strong>to</strong> Italy.<br />

A Certificate <strong>of</strong> Free Circulation is required<br />

for permanent <strong>export</strong>.
