Most <strong>of</strong>ten, musicians with old instruments who regularly travel for concerts outside Slovenia<br />
apply for <strong>the</strong> specific open licence. This allows <strong>the</strong>m unlimited <strong>export</strong> <strong>and</strong> re-<strong>import</strong><br />
<strong>of</strong> <strong>the</strong> instrument for a period <strong>of</strong> up <strong>to</strong> five years.<br />
I am a <strong>to</strong>urist visiting Slovenia. If I buy a work <strong>of</strong> art, how do I take it home with me?<br />
The <strong>export</strong> regulations apply <strong>to</strong> anyone who wants <strong>to</strong> take <strong>cultural</strong> <strong>goods</strong> <strong>of</strong> a certain age<br />
<strong>and</strong> value from Slovenia <strong>to</strong> <strong>Russia</strong> (or <strong>to</strong> ano<strong>the</strong>r country outside <strong>the</strong> EU cus<strong>to</strong>ms area).<br />
You must go through <strong>the</strong> application process with <strong>the</strong> Ministry <strong>of</strong> Culture <strong>of</strong> Slovenia in<br />
order for <strong>the</strong> <strong>goods</strong> <strong>to</strong> be cleared for <strong>export</strong>.<br />
If you have bought <strong>the</strong> art work, antique, furniture or o<strong>the</strong>r <strong>cultural</strong> <strong>goods</strong> from a<br />
reputable art or antique dealer, ask <strong>the</strong>ir advice on how <strong>to</strong> apply for <strong>the</strong> <strong>export</strong><br />
licence.<br />
Since <strong>the</strong> application process takes up <strong>to</strong> three weeks, you should note that <strong>the</strong> <strong>goods</strong><br />
must remain in Slovenia until <strong>the</strong> licence has been granted <strong>and</strong> you may have <strong>to</strong> arrange<br />
transportation at a later date.<br />
If you are in any doubt, check <strong>the</strong> age <strong>and</strong> value <strong>of</strong> <strong>the</strong> <strong>cultural</strong> <strong>goods</strong>. This determines<br />
whe<strong>the</strong>r an EU <strong>export</strong> licence is required. In general, <strong>export</strong> controls apply <strong>to</strong><br />
<strong>cultural</strong> <strong>goods</strong> which are over 50 years old <strong>and</strong> <strong>of</strong> a certain value. You have <strong>to</strong> check<br />
also whe<strong>the</strong>r your object falls under <strong>the</strong> categories covered by national legislation<br />
in Slovenia.<br />
Is <strong>the</strong>re a fee for an <strong>export</strong> licence?<br />
Yes, when applying for an <strong>export</strong> licence in Slovenia an administrative duty (upravna<br />
taksa) has <strong>to</strong> be paid. Public institutions are exempted from payment <strong>of</strong><br />
this duty.<br />
Does <strong>the</strong> <strong>cultural</strong> object need <strong>to</strong> be valued? If so, who will do this?<br />
Yes, in <strong>the</strong> licence-issuing procedure <strong>the</strong> Ministry <strong>of</strong> Culture obtains expert opinions from<br />
<strong>the</strong> competent national museums in Slovenia. Such opinion must be prepared within 14<br />
days <strong>of</strong> being requested by <strong>the</strong> Ministry.<br />
Can I appeal against <strong>the</strong> valuation? If so, how do I do this?<br />
No.<br />
If an <strong>export</strong> licence is refused, can I appeal? How do I do that?<br />
You can put a lawsuit at <strong>the</strong> Administrative Court <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> Slovenia (Tržaška 68a,<br />
Ljubljana) within 30 days <strong>of</strong> receiving <strong>the</strong> refusal.<br />
