Which cus<strong>to</strong>ms authorities are empowered <strong>to</strong> deal with <strong>the</strong> <strong>export</strong> <strong>of</strong> <strong>cultural</strong> <strong>goods</strong>?<br />

All cus<strong>to</strong>ms <strong>of</strong>fices in Slovenia are entitled <strong>to</strong> deal with <strong>the</strong> <strong>export</strong> <strong>of</strong> <strong>cultural</strong> <strong>goods</strong>. The<br />

details <strong>of</strong> <strong>the</strong> Cus<strong>to</strong>ms Administration <strong>of</strong> Slovenia are given below.<br />

What o<strong>the</strong>r paperwork do I need <strong>to</strong> <strong>export</strong> a <strong>cultural</strong> object?<br />

When you are granted an <strong>export</strong> licence in Slovenia, you keep one copy, <strong>the</strong> second copy<br />

being presented <strong>to</strong> <strong>the</strong> cus<strong>to</strong>ms <strong>of</strong>ficials.<br />

What are <strong>the</strong> penalties if I do something wrong?<br />

The Protection <strong>of</strong> Cultural Heritage Act sets out <strong>the</strong> penalties for individuals <strong>and</strong> organisations<br />

that attempt <strong>to</strong> <strong>export</strong> <strong>cultural</strong> <strong>goods</strong> without <strong>the</strong> relevant licence. Usually, <strong>export</strong><br />

without a licence also implies violation <strong>of</strong> cus<strong>to</strong>ms rules, <strong>and</strong> <strong>the</strong> relevant additional penalties<br />

apply. For more serious cases <strong>of</strong> illegal <strong>export</strong> or <strong>import</strong> <strong>of</strong> <strong>cultural</strong> <strong>goods</strong>, <strong>the</strong> Criminal<br />

Code regulations can apply.<br />

If a responsible <strong>of</strong>ficer or national museum establishes that <strong>the</strong>re is suspicion that an object<br />

has been <strong>import</strong>ed contrary <strong>to</strong> <strong>the</strong> legislation <strong>of</strong> <strong>the</strong> <strong>export</strong>ing country, or that it has<br />

in some o<strong>the</strong>r way been unlawfully obtained or deliberately damaged so as <strong>to</strong> reduce its<br />

value, <strong>the</strong>y take action in accordance with <strong>the</strong> Criminal Procedure Act.<br />

What are <strong>the</strong> st<strong>and</strong>ards <strong>of</strong> service I can expect <strong>to</strong> receive?<br />

Are <strong>the</strong>re any special <strong>export</strong> restrictions on certain objects or o<strong>the</strong>r considerations I should<br />

know about?<br />

The permanent <strong>export</strong> or transfer <strong>of</strong> an object can be prohibited by <strong>the</strong> Minister <strong>of</strong> Culture<br />

by means <strong>of</strong> a decision. This takes place if <strong>the</strong> expert opinion establishes that a given<br />

object forms part <strong>of</strong> <strong>the</strong> national treasure <strong>of</strong> Slovenia.<br />

What are <strong>the</strong> requirements if I want <strong>to</strong> <strong>import</strong> <strong>cultural</strong> <strong>goods</strong> in<strong>to</strong> Slovenia from <strong>Russia</strong>?<br />

You do not need a special permit for such <strong>import</strong>. Since <strong>Russia</strong>, like Slovenia, ratified<br />

<strong>the</strong> UNESCO Convention <strong>of</strong> 1970, Slovenian cus<strong>to</strong>ms will only need <strong>to</strong> check <strong>the</strong> <strong>export</strong><br />

documentation issued in <strong>Russia</strong> for <strong>the</strong> relevant <strong>cultural</strong> <strong>goods</strong>.<br />
