Chapter 3: European Union Member States<br />

It is likely that you will have <strong>to</strong> apply <strong>to</strong> <strong>the</strong> Ministry <strong>of</strong> Culture, unless you intend <strong>to</strong> <strong>export</strong><br />

archives or archival documents over 50 years old, in which case you apply <strong>to</strong> <strong>the</strong> Ministry<br />

<strong>of</strong> Interior.<br />

The procedure for issuing a licence can last a number <strong>of</strong> weeks, so you may have <strong>to</strong> leave<br />

<strong>the</strong> object in Slovakia <strong>and</strong> <strong>the</strong>n arrange for its transport <strong>to</strong> <strong>Russia</strong>. In any case, <strong>the</strong> object<br />

has <strong>to</strong> be presented <strong>to</strong> Slovak cus<strong>to</strong>ms <strong>to</strong>ge<strong>the</strong>r with <strong>the</strong> <strong>export</strong> declaration.<br />

Is <strong>the</strong>re a fee for an <strong>export</strong> licence?<br />

No, you do not have <strong>to</strong> pay a fee for <strong>the</strong> issuing <strong>of</strong> a licence.<br />

Does <strong>the</strong> <strong>cultural</strong> object need <strong>to</strong> be valued? If so, who will do this?<br />

The Ministry <strong>of</strong> Culture decides on <strong>the</strong> permanent <strong>export</strong> <strong>of</strong> an object <strong>of</strong> museum or gallery<br />

value based on <strong>the</strong> recommendation <strong>of</strong> <strong>the</strong> advisory body <strong>of</strong> <strong>the</strong> Ministry <strong>of</strong> Culture – <strong>the</strong><br />

Commission for <strong>the</strong> Protection <strong>of</strong> Parts <strong>of</strong> <strong>the</strong> Cultural Heritage – which also verifies whe<strong>the</strong>r<br />

<strong>the</strong> object is recorded as a <strong>cultural</strong> monument in <strong>the</strong> Central List <strong>of</strong> His<strong>to</strong>rical Monuments<br />

Fund. The applicant is obliged <strong>to</strong> submit an expert opinion on request <strong>and</strong> bears <strong>the</strong> costs<br />

<strong>of</strong> this opinion.<br />

Can I appeal against <strong>the</strong> valuation? If so, how do I do this?<br />

Assessment <strong>of</strong> <strong>the</strong> objects is conducted by experts in <strong>the</strong> relevant field. Under <strong>the</strong> national<br />

legislation it is possible <strong>to</strong> file a complaint. Complaints against <strong>the</strong> experts while performing<br />

<strong>the</strong>ir expert activities are h<strong>and</strong>led by <strong>the</strong> Ministry <strong>of</strong> Justice.<br />

If an <strong>export</strong> licence is refused, can I appeal? How do I do that?<br />

According <strong>to</strong> Act No. 71/1967 Coll. on administrative proceedings (Administrative Code)<br />

in <strong>the</strong> wording <strong>of</strong> Act No. 215/2002 Coll., an appeal against <strong>the</strong> decision on <strong>the</strong> rejection<br />

<strong>of</strong> an <strong>export</strong> permit is possible.<br />

Which cus<strong>to</strong>ms authorities are empowered <strong>to</strong> deal with <strong>the</strong> <strong>export</strong> <strong>of</strong> <strong>cultural</strong> <strong>goods</strong>?<br />

What o<strong>the</strong>r paperwork do I need <strong>to</strong> <strong>export</strong> a <strong>cultural</strong> object?<br />

You need <strong>to</strong> present <strong>the</strong> <strong>export</strong> licence <strong>to</strong> Slovak cus<strong>to</strong>ms <strong>to</strong>ge<strong>the</strong>r with <strong>the</strong> <strong>export</strong> declaration.<br />

What are <strong>the</strong> penalties if I do something wrong?<br />

According <strong>to</strong> <strong>the</strong> regime for issuing <strong>export</strong> permits as set out in Article 9 <strong>of</strong> Council Regulation<br />

3911/92, each Member State shall establish sanctions for violations <strong>of</strong> provisions <strong>of</strong> this Regu-<br />
