Slovenia<br />

categories under Council Regulation 3911/92 or <strong>the</strong> Slovenia Rules on <strong>the</strong> Identifying <strong>of</strong><br />

Cultural Heritage Objects, <strong>the</strong> Ministry <strong>of</strong> Culture issues a certificate guaranteeing that <strong>the</strong><br />

<strong>export</strong> or transfer <strong>of</strong> <strong>the</strong> object is permitted.<br />

This possibility was introduced once experience showed that in many cases, nei<strong>the</strong>r <strong>of</strong><br />

<strong>the</strong> parties concerned nor <strong>the</strong> cus<strong>to</strong>ms authorities could evaluate with certainty whe<strong>the</strong>r<br />

an object was a <strong>cultural</strong> good, as defined by <strong>the</strong> legislation.<br />

Do museums <strong>and</strong> galleries need licences for temporary <strong>export</strong>s (e.g. a <strong>to</strong>uring exhibition)? Do<br />

non-pr<strong>of</strong>it organisations need <strong>export</strong> licences?<br />

Yes. Museums, galleries <strong>and</strong> non-pr<strong>of</strong>it organisations must apply for licences. Any <strong>cultural</strong><br />

<strong>goods</strong> that fall under any <strong>of</strong> <strong>the</strong> categories described in <strong>the</strong> Slovenian national legislation<br />

<strong>and</strong>/or EU <strong>export</strong> licence legislation must be covered by an <strong>export</strong> licence, whatever <strong>the</strong><br />

type <strong>of</strong> applicant or purpose.<br />

If <strong>the</strong> <strong>cultural</strong> <strong>goods</strong> belong <strong>to</strong> a public collection (museums, libraries, archives) <strong>and</strong> is <strong>to</strong><br />

be presented in a temporary exhibition outside Slovenia, a st<strong>and</strong>ard <strong>export</strong> licence must<br />

be applied for.<br />

Slovenian legislation also provides for <strong>the</strong> so-called general open <strong>export</strong> licences. These are<br />

valid for a maximum <strong>of</strong> five years <strong>and</strong> allow for multiple temporary <strong>export</strong> <strong>of</strong> an object that<br />

is part <strong>of</strong> <strong>the</strong> permanent collection <strong>of</strong> a museum or o<strong>the</strong>r institution housing a collection. The<br />

licence may be used for any combination <strong>of</strong> objects in a permanent collection on any occasion<br />

<strong>of</strong> temporary <strong>export</strong>. It may also be used for a range <strong>of</strong> various combinations <strong>of</strong> objects, ei<strong>the</strong>r<br />

progressively or simultaneously. In all cases, before any <strong>export</strong> out <strong>of</strong> Slovenia, <strong>the</strong> Ministry <strong>of</strong><br />

Culture must be notified at least five days before <strong>the</strong> start <strong>of</strong> <strong>the</strong> procedure or transport.<br />

For general open <strong>export</strong> licences, <strong>the</strong> expert opinion must include an assessment <strong>of</strong> <strong>the</strong><br />

existence <strong>of</strong> necessary guarantees for <strong>the</strong> return <strong>of</strong> <strong>the</strong> object <strong>to</strong> Slovenia.<br />

I am a visual artist. Do I need a licence <strong>to</strong> <strong>export</strong> my own work?<br />

No. You can get written confirmation from <strong>the</strong> Ministry <strong>of</strong> Culture that your work is not<br />

covered by Council Regulation 3911/92 or by Slovenian legislation.<br />

If you own your work or if you want <strong>to</strong> exhibit <strong>the</strong> work <strong>of</strong> a living artist, <strong>and</strong> you intend <strong>to</strong> exhibit<br />

it abroad with <strong>the</strong> possibility <strong>of</strong> sale, you are recommended <strong>to</strong> get such confirmation. It<br />

will facilitate cus<strong>to</strong>ms procedures <strong>and</strong> <strong>the</strong> free circulation <strong>of</strong> <strong>the</strong> work from <strong>and</strong> <strong>to</strong> Slovenia.<br />

I am a musician. Do I need <strong>to</strong> know about <strong>export</strong> regulations if I am travelling with my<br />

instrument?<br />

Yes. Any musician who wishes <strong>to</strong> travel with a musical instrument which is over a certain<br />

age <strong>and</strong> value must obtain an EU <strong>export</strong> licence (as described in Chapter 2). This applies<br />

whe<strong>the</strong>r <strong>the</strong> <strong>export</strong> is temporary, e.g. for a concert <strong>to</strong>ur, or permanent.<br />
