Sweden<br />

<strong>to</strong> arrange for transportation at a later date. Alternatively you can return <strong>to</strong> Sweden <strong>to</strong> collect<br />

<strong>the</strong> <strong>goods</strong> in person when <strong>the</strong> <strong>export</strong> licences have been granted.<br />

If you are in any doubt, check <strong>the</strong> age <strong>and</strong> value <strong>of</strong> <strong>the</strong> <strong>cultural</strong> <strong>goods</strong>. This determines<br />

whe<strong>the</strong>r an <strong>export</strong> licence is required. In general, <strong>the</strong> <strong>export</strong> controls apply <strong>to</strong> <strong>cultural</strong> <strong>goods</strong><br />

which are over 50 years old <strong>and</strong> <strong>of</strong> a certain value (see Chapter 2 for more details).<br />

Is <strong>the</strong>re a fee for an <strong>export</strong> licence?<br />

No – <strong>the</strong>re is no fee for <strong>the</strong> licence. There are no duties or taxes <strong>to</strong> be paid on <strong>export</strong> but<br />

<strong>the</strong>re may be cus<strong>to</strong>ms duties <strong>to</strong> pay.<br />

Does <strong>the</strong> <strong>cultural</strong> object need <strong>to</strong> be valued? If so, who will do this?<br />

Both <strong>the</strong> EU <strong>and</strong> Swedish national legislation have value <strong>and</strong> age thresholds which determine<br />

which <strong>cultural</strong> objects require <strong>export</strong> licences. Therefore, if <strong>the</strong> age, value or o<strong>the</strong>r<br />

determinants need <strong>to</strong> be assessed, <strong>the</strong> <strong>cultural</strong> object may have <strong>to</strong> be inspected.<br />

The five national licensing authorities in Sweden provide <strong>the</strong> expertise <strong>to</strong> determine <strong>the</strong><br />

age <strong>and</strong> value <strong>of</strong> <strong>the</strong> object <strong>and</strong> may request an examination <strong>of</strong> <strong>the</strong> actual object. The cost<br />

<strong>of</strong> <strong>the</strong> valuation is borne by <strong>the</strong> licensing authorities.<br />

If an <strong>export</strong> licence is refused, can I appeal? How do I do that?<br />

If an <strong>export</strong> permit application has been refused by a licensing authority, you can make an<br />

appeal at a general administrative court. Special permission (‘leave <strong>to</strong> appeal’) is required<br />

if you want <strong>to</strong> make an appeal <strong>to</strong> an Administrative Court <strong>of</strong> Appeal. The court can decide<br />

on valuation.<br />

Which cus<strong>to</strong>ms authorities are empowered <strong>to</strong> deal with <strong>the</strong> <strong>export</strong> <strong>of</strong> <strong>cultural</strong> <strong>goods</strong>?<br />

All cus<strong>to</strong>ms authorities in Sweden are empowered <strong>to</strong> deal with <strong>the</strong> <strong>export</strong> <strong>of</strong> <strong>cultural</strong><br />

<strong>goods</strong>.<br />

What o<strong>the</strong>r paperwork do I need <strong>to</strong> <strong>export</strong> a <strong>cultural</strong> object?<br />

When you leave Sweden, you must show <strong>the</strong> <strong>export</strong> permit <strong>and</strong>, if <strong>export</strong> is <strong>to</strong> a country<br />

outside <strong>the</strong> EU, you must also show <strong>the</strong> ‘cus<strong>to</strong>m permit’ (EU <strong>export</strong> licence).<br />

When you enter <strong>Russia</strong>, you must show all <strong>the</strong> relevant documentation <strong>and</strong> declare <strong>the</strong> object<br />

at cus<strong>to</strong>ms, passing through <strong>the</strong> Red channel. See Chapter 4 for fur<strong>the</strong>r information.<br />

What are <strong>the</strong> penalties if I do something wrong?<br />

Anyone who <strong>export</strong>s an art object from Sweden without a permit can be convicted according<br />

<strong>to</strong> <strong>the</strong> law <strong>of</strong> smuggling. Both smuggling <strong>and</strong> attempting <strong>to</strong> smuggle is punisha-<br />
