Denmark<br />

ish Commission’s permission if <strong>the</strong> buyer wishes <strong>to</strong> take <strong>the</strong>m out <strong>of</strong> Denmark after <strong>the</strong><br />

auction. In such cases <strong>the</strong> auctioneer is obliged <strong>to</strong> keep <strong>the</strong> relevant items in cus<strong>to</strong>dy until<br />

an <strong>export</strong> licence has been granted.<br />

In 2005 <strong>the</strong> Commission made advance examinations <strong>of</strong> 34 sales catalogues comprising<br />

18,545 catalogue items. They made reservations in <strong>the</strong> case <strong>of</strong> seven objects.<br />

Since <strong>the</strong> <strong>export</strong> licence application process takes up <strong>to</strong> a month, you should note that<br />

<strong>the</strong> <strong>goods</strong> must remain in Denmark until <strong>the</strong> <strong>export</strong> licence has been granted, after which<br />

you can arrange transportation.<br />

Is <strong>the</strong>re a fee for an <strong>export</strong> licence?<br />

No – <strong>the</strong>re is no fee for <strong>the</strong> licence.<br />

Does <strong>the</strong> <strong>cultural</strong> object need <strong>to</strong> be valued? If so, who will do this?<br />

When you apply, you must provide an assessment <strong>of</strong> <strong>the</strong> value <strong>of</strong> <strong>the</strong> object, made by<br />

an expert in <strong>the</strong> field. You must also provide information on where <strong>the</strong> object can be<br />

inspected.<br />

For each application, experts from national institutions <strong>and</strong> museums on <strong>the</strong> Commission<br />

give <strong>the</strong>ir opinion on <strong>the</strong> impact on national heritage if <strong>the</strong> <strong>goods</strong> were <strong>to</strong> be <strong>export</strong>ed.<br />

Can I appeal against <strong>the</strong> valuation? If so, how do I do this?<br />

It is not possible <strong>to</strong> appeal against <strong>the</strong> decision on <strong>import</strong>ance for national heritage.<br />

If an <strong>export</strong> licence is refused, can I appeal? How do I do that?<br />

If an application for an <strong>export</strong> licence is refused, <strong>the</strong> State must <strong>of</strong>fer <strong>to</strong> buy <strong>the</strong> object at<br />

market price, although it has no right <strong>of</strong> pre-emption. The value <strong>of</strong> <strong>the</strong> object is fixed on<br />

advice from special experts. If <strong>the</strong> owner does not accept <strong>the</strong> <strong>of</strong>fer within three months, it<br />

lapses. Legal action can be taken through <strong>the</strong> courts if an <strong>export</strong> licence is refused.<br />

Which cus<strong>to</strong>ms authorities are empowered <strong>to</strong> deal with <strong>the</strong> <strong>export</strong> <strong>of</strong> <strong>cultural</strong> <strong>goods</strong>?<br />

All cus<strong>to</strong>ms <strong>of</strong>fices in Denmark can deal with <strong>export</strong> <strong>of</strong> <strong>cultural</strong> <strong>goods</strong>.<br />

What o<strong>the</strong>r paperwork do I need <strong>to</strong> <strong>export</strong> a <strong>cultural</strong> object?<br />

When you leave Denmark, you must show <strong>the</strong> relevant <strong>export</strong> licences.<br />

When you enter <strong>Russia</strong>, you must show all <strong>the</strong> relevant documentation <strong>and</strong> declare<br />

<strong>the</strong> object at cus<strong>to</strong>ms, passing through <strong>the</strong> Red channel. See Chapter 4 for fur<strong>the</strong>r<br />
