Chapter 3: European Union Member States<br />

is granted, experts from national institutions <strong>and</strong> museums give <strong>the</strong>ir opinion on <strong>the</strong> impact<br />

on <strong>the</strong> national heritage if <strong>the</strong> <strong>goods</strong> were <strong>export</strong>ed. The question <strong>the</strong>y ask is whe<strong>the</strong>r<br />

<strong>the</strong> <strong>export</strong> would cause a substantial loss <strong>to</strong> national <strong>cultural</strong> heritage.<br />

Are <strong>the</strong>re any exemptions for particular <strong>cultural</strong> <strong>goods</strong>?<br />

Coins <strong>and</strong> medals are <strong>the</strong> only <strong>cultural</strong> objects explicitly exempted from <strong>the</strong> national<br />

regulations.<br />

Do museums <strong>and</strong> galleries need licences for temporary <strong>export</strong>s (e.g. a <strong>to</strong>uring exhibition)? Do<br />

non-pr<strong>of</strong>it organisations need <strong>export</strong> licences?<br />

Yes. Museums, galleries <strong>and</strong> non-pr<strong>of</strong>it organisations must apply for licences. Any <strong>cultural</strong><br />

<strong>goods</strong> that fall under <strong>the</strong> categories described in <strong>the</strong> Danish national legislation <strong>and</strong>/or<br />

EU <strong>export</strong> licence legislation must be covered by an <strong>export</strong> licence, whatever <strong>the</strong> type <strong>of</strong><br />

applicant or purpose.<br />

Under <strong>the</strong> legislation, <strong>the</strong> Cultural Assets Commission may grant a st<strong>and</strong>ing <strong>export</strong> licence<br />

<strong>to</strong> state-owned or state-subsidised museums, or o<strong>the</strong>rs <strong>export</strong>ing <strong>cultural</strong> objects in connection<br />

with exhibitions <strong>and</strong> <strong>the</strong> like abroad.<br />

I am a visual artist. Do I need a licence <strong>to</strong> <strong>export</strong> my own work?<br />

No. Art work which belongs <strong>to</strong> “<strong>the</strong> origina<strong>to</strong>r” (i.e. <strong>the</strong> artist who created it) does not require<br />

an <strong>export</strong> licence under <strong>the</strong> EU <strong>export</strong> licence legislation, whatever its age or value.<br />

Therefore you do not need a licence <strong>to</strong> <strong>export</strong> your own work if you still own it yourself.<br />

I am a musician. Do I need <strong>to</strong> know about <strong>export</strong> regulations if I am travelling with my<br />

instrument?<br />

Yes. Any musician who wishes <strong>to</strong> travel outside <strong>the</strong> European Union with a musical instrument<br />

which is over a certain age <strong>and</strong> value must obtain an EU <strong>export</strong> licence (as described in Chapter<br />

2). This applies whe<strong>the</strong>r <strong>the</strong> <strong>export</strong> is temporary, e.g. for a concert <strong>to</strong>ur, or permanent.<br />

I am a <strong>to</strong>urist visiting Denmark. If I buy a work <strong>of</strong> art, how do I take it home with me?<br />

The <strong>export</strong> regulations apply <strong>to</strong> anyone who wants <strong>to</strong> take <strong>cultural</strong> <strong>goods</strong> <strong>of</strong> a certain<br />

age <strong>and</strong> value from Denmark <strong>to</strong> <strong>Russia</strong> (or <strong>to</strong> ano<strong>the</strong>r country). You must go through <strong>the</strong><br />

application process with <strong>the</strong> Danish Commission in order for <strong>the</strong> <strong>goods</strong> <strong>to</strong> be cleared for<br />

<strong>export</strong>.<br />

As a <strong>to</strong>urist, you should be aware <strong>of</strong> how <strong>the</strong> regulations are applied <strong>to</strong> sales from auction<br />

houses. The Commission on Export <strong>of</strong> Cultural Assets has made an agreement with<br />

certain auction houses on a special procedure. Prior <strong>to</strong> <strong>the</strong> auction <strong>the</strong> Commission will<br />

go through <strong>the</strong> catalogue <strong>and</strong> if necessary inspect relevant items. On <strong>the</strong> basis <strong>of</strong> this<br />

inspection <strong>the</strong>y will <strong>the</strong>n advise <strong>the</strong> auctioneer in writing which items will require <strong>the</strong> Dan-<br />
