education <strong>and</strong> health. These are claims for attention <strong>and</strong> assistance. What all of these<br />
claims have <strong>in</strong> common is that they <strong>in</strong>volve an entitlement to help from others to<br />
respect, protect <strong>and</strong> fulfil their rights <strong>in</strong> defence of freedoms <strong>and</strong> capacities (UNDP,<br />
2000 pp. 19-26). Thus, if human development is the process of exp<strong>and</strong><strong>in</strong>g <strong>in</strong>dividuals’<br />
capacities <strong>and</strong> freedoms, then human rights are a claim that <strong>in</strong>dividuals have to secure<br />
those capacities <strong>and</strong> freedoms.<br />

right not to be beaten, the right to study so that tomorrow they might be<br />
someone, to be protected by the police <strong>and</strong> by their elders.”<br />

Human rights establish a set of pr<strong>in</strong>ciples to which the development process can<br />
aspire. A rights-based perspective establishes basic m<strong>in</strong>imum st<strong>and</strong>ards to which<br />
<strong>in</strong>dividuals can lay claim <strong>and</strong> consequently def<strong>in</strong>es the duty of others to ensure that<br />
those rights are realised. Duties imply responsibilities <strong>and</strong> accountability. Assert<strong>in</strong>g<br />
a claim to education is not only say<strong>in</strong>g that education is needed or is a good th<strong>in</strong>g.<br />
It is to say that children are entitled to an education. If some children are deprived<br />
of education, it is essential to engage <strong>in</strong> a process through which the persons or<br />
systems responsible for the deprivation of the children’s rights are identified <strong>and</strong><br />
actively <strong>in</strong>volved <strong>in</strong> f<strong>in</strong>d<strong>in</strong>g solutions to ensure the progressive realisation of children’s<br />
right to education.<br />
<strong>Child</strong>ren’s rights are formally set out <strong>in</strong> <strong>in</strong>ternational <strong>and</strong> national law. <strong>Mozambique</strong><br />
is a signatory to the ma<strong>in</strong> <strong>in</strong>ternational human rights conventions related to children<br />
(see Box 1.1 below). Through these commitments, the Government has assumed the<br />
primary responsibility for work<strong>in</strong>g to respect, protect <strong>and</strong> fulfil children’s rights <strong>in</strong> all of<br />
their dimensions.<br />
