3.2.4 De eerste aanzet daar<strong>voor</strong> is gegeven in een uitspraak van het Poolse<br />
Constitutionele Hof van 12 Januari 2000. Het Poolse Constitutionele<br />
Hof besliste in die uitspraak als volgt:<br />
“It is the Constitutional Court’s opinion that, in consequence,<br />
the right to derive profit from property, which is an important<br />
element of the right of property, has been destroyed and, at the<br />
same time, the second element, the right to dispose of one’s<br />
property, has been stripped of its substance. In consequence, the<br />
right of property has become illusory and unable to fulfill its<br />
purpose in the legal order based on the principles listed in<br />
Article 20 of the Constitution.”<br />
3.2.5 In zijn arrest van 22 februari 2005 inzake Hutten-Czapska versus Polen<br />
neemt het EHRM (vierde kamer) deze tekst letterlijk over in<br />
randnummer 176:<br />
“Against that background and having regard to the<br />
consequences that the various restrictive provisions had on the<br />
applicant, the Court finds that the combination of restrictions<br />
under the 1994 Act impaired the very essence of her right of<br />
property. In that regard the Court would point out that the<br />
Constitutional Court, in its judgment of 12 January 2000, came<br />
to the same conclusion, holding that under the 1994 Act the<br />
individual landlords had been “deprived even of the slightest<br />
substance of their property rights” and that, “in consequence<br />
the[ir] right to derive profit from property, ... an important<br />
element of the right of property ha[d] been destroyed and ...<br />
the[ir] right to dispose of one’s property ha[d] been stripped of<br />
its substance” (see paragraph 86 above).”<br />
3.2.6 In het kader van aanbevelingen <strong>voor</strong> een verbeterde wetgeving (d.d. 29<br />
juni 2005) gaf het Poolse Constitutionele Hof een fundamentele<br />
uiteenzetting over de factoren, die van invloed zijn op het niveau van de<br />
“basic rent”. “Decent profit” vormt een onmisbaar element <strong>voor</strong> de<br />
bescherming van eigendomsrechten:<br />
“3. Factors influencing the level of so-called ‘basic rent’<br />
[czynszpoczątkowy] The question of determining rent and<br />
charges for the use of the dwelling cannot be seen only from the<br />
perspective of the criteria and rules for their increase. First of<br />
all, it is necessary to set a statutory starting point – in other<br />
words, elements of rent that would adequately take into account<br />
the rights of landlords. At the same time, not losing sight of the<br />
necessarily complementary relationship between a landlord and<br />
a tenant, one should have regard to the fact that the essential<br />
