The Best Practice Regulation Handbook is a tool to<br />
facilitate the implementation of the National Policy.<br />
The Handbook should be used in conjunction<br />
with the National Policy document and provides<br />
guidance for compliance to the policy and<br />
process. It is intended that flexibility is available<br />
for implementation as far as the principles and key<br />
process steps are adhered to. Existing arrangements<br />
should be reviewed to ensure that these fulfill the<br />
policy and process requirements and changes<br />
made when the existing arrangements as indicated.<br />
National Policy on the Development and<br />
Implementation of Regulations as well as Best<br />
Practice Regulation Handbook have been<br />
developed through a consultative process<br />
coordinated by the <strong>Malaysia</strong> <strong>Productivity</strong><br />
<strong>Corporation</strong> (<strong>MPC</strong>). Consultations were held and<br />
inputs from a wide range of stakeholders within<br />
government that include representatives from<br />
all ministries and agencies responsible for the<br />
development and implementation of regulations<br />
in a number of sessions held in February and March<br />
2012. These documents were made available for<br />
review on <strong>MPC</strong> website and all affected parties were<br />
invited to submit their comments on the drafted<br />
policy and the Best Practice Regulation Handbook.<br />
Many useful and constructive comments received<br />
during the consultation sessions and those directly<br />
communicated to <strong>MPC</strong> have been incorporated<br />
into the two documents.<br />
The capacity and capability of all parties<br />
involved in the management, development and<br />
implementation of regulations will be upgraded<br />

and the governance and organisational structures<br />
were reviewed to meet the requirements of<br />
international best practices. The inter-connected<br />
nature of the issues dictate that this change be<br />
undertaken in an integrated manner by involving<br />
various Ministries, agencies, industries and other<br />
stakeholders.<br />
The requirements for Best Practice Regulation in<br />
<strong>Malaysia</strong> include that every Ministry or Regulator<br />
should:<br />
1. Appoint Regulatory Coordinator(s) and notify<br />
the appointment to the gatekeeper;<br />
2. Develop and maintain a system to manage the<br />
regulatory process that meets the requirements;<br />
3. Ensure new regulations to be in accordance<br />
with the defined process;<br />
4. Ensure regulations to serve defined<br />
objectives. Regulatory authorities proposing<br />
new regulatory requirements or regulatory<br />
changes must have clear objectives, evidence<br />
that a problem has arisen, that Government<br />
intervention is required and that new regulatory<br />
requirements are necessary;<br />
5. Examine alternatives, assess impact, hold<br />
consultations & define implementation<br />
strategy; and<br />
6. Explain proposals to stakeholders, maintain<br />
process records & train personnel.<br />
