Tributação do Imobiliário Municípi<strong>os</strong>, Imp<strong>os</strong>t<strong>os</strong> & outras novidades 106 Ana Chacim Senior Manager, Tax Services O ano de 2019 aguarda ainda as habituais prop<strong>os</strong>tas para aprovação em sede de Orçamento do Estado, às quais se juntarão as novidades recentemente trazidas pela Lei n.o 51/2018, 16.08, pela introdução de alterações ao regime financeiro das autarquias locais e das entidades intermunicipais, bem como ao Código do Imp<strong>os</strong>to Municipal sobre Imóveis (IMI). No campo tributário, o referido diploma vem alargar o elenco das receitas municipais ao produto da cobrança de contribuições, designadamente em matéria de proteção civil. Recorde-se que o atual quadro jurídico prevê apenas a p<strong>os</strong>sibilidade de <strong>os</strong> municípi<strong>os</strong> cobrarem taxas pela prestação de serviç<strong>os</strong> em matéria de prevenção de risc<strong>os</strong> e proteção civil, cuj<strong>os</strong> contorn<strong>os</strong> no respetivo desenho levariam, potencialmente, a um juízo de inconstitucionalidade relativamente às taxas municipais de Vila Nova de Gaia, Lisboa e Setúbal. Feita a sinalização normativa, aguarda-se assim a consagração do regime legal que legitimará <strong>os</strong> municípi<strong>os</strong> na cobrança de contribuições. Numa tentativa de maior conexão territorial entre a receita municipal e a dinâmica económica local, a nova Lei prevê a atribuição do direito a<strong>os</strong> municípi<strong>os</strong> a uma participação de 7,5% na receita do IVA (liquidado) relativo às atividades económicas de alojamento, restauração comunicações, eletricidade, água e gás. Mas não se pense apenas na perspetiva de novas receitas e a sobrecarga com o seu custo. O inevitável processo de dinamização económica ao nível local, acompanhado da tão esperada descentralização de competências, compreende várias perspetivas, devendo assumir-se uma ação integrada no que respeita à autonomia e capacitação d<strong>os</strong> govern<strong>os</strong> locais em matéria de receita e de despesa. Se, por um lado, é reconhecida a imperatividade quanto à maior responsabilização d<strong>os</strong> autarcas na gestão municipal, norteada por um juízo de eficiência e economicidade da despesa pública, por outro, cabe a<strong>os</strong> mesm<strong>os</strong> alavancar as potencialidades económicas locais, recorrendo ao investimento comunitário existente, mas também a instrument<strong>os</strong> fiscais. Veja-se a clarificação efetuada quanto à criação de taxas municipais em resp<strong>os</strong>ta ao benefício económico decorrente d<strong>os</strong> investiment<strong>os</strong> realizad<strong>os</strong>. Neste sentido, compreende-se a obrigatoriedade agora introduzida para aprovação de um regulamento municipal com a previsão d<strong>os</strong> critéri<strong>os</strong> e condições para o reconhecimento das isenções relativas a<strong>os</strong> imp<strong>os</strong>t<strong>os</strong> municipais. Numa ótica de racionalização de despesa pública (fiscal), mas igualmente para garantia de igualdade de acesso a<strong>os</strong> incentiv<strong>os</strong> públic<strong>os</strong> (fiscais), promove-se indubitavelmente uma maior transparência na atuação pública municipal. Inclui-se neste domínio a criação de isenções ou taxas reduzidas de derrama, sendo eliminada a habitual taxa reduzida de derrama para sujeit<strong>os</strong> passiv<strong>os</strong> cujo volume de negóci<strong>os</strong> não ultrapasse <strong>os</strong> €150.000, até à aprovação do referido regulamento. Sendo exigida a devida racionalização, salienta-se ainda a alteração ao Código do IMI, pela qual se exclui da isenção atribuída às entidades públicas o “património imobiliário público sem utilização”, promovendo e incentivando a difícil disponibilização de edifíci<strong>os</strong> públic<strong>os</strong> que por vezes se verifica.
