(Aøacum, la extrema cealaltæ – øi doar pentru a sugera în treacæt felul cum chestiuneadelicatæ a pragului de la care începe excesul abandonului ca neglijenflæforms – in our everyday lives than we would like to admit; a dammage alreadyaffecting, perhaps, the ethic (ethical-political) foundations of the “natural”base of the diachronic reproduction of the social bond in the conditions of the(post)modern life (filiation, family relations, parental responsibility in theprocess of shaping and humanizing the infans subject); at last, a symptom, ofa relational misery or deficiency, before we ca talk about a purely economicalone (extreme poverty) and which simply, in an apparent paradox, only revivedjust its most brutal expressions from the times of the industrial revolution (seethe novels of a Dickens), all these are continuously suggested by the numerousadditional features added especially further to the base design of thesefigures of the abandonment. It was proved, a posteriori, implicitly and with nointention whatsoever, but de plano, by the government itself when, findinghimself interested, willingly or not, in mobilizing the necessary will (under thedeadline pressures of the E.U. admission – a “maturity” certificate for thecountry, isn’t so), found out, after more than 10 years from the collapse of theold regime, how to finally stop the “export of abandoned children”, whichflourished in that very period. It is proven, even more incisive, by the followingthing. The two extreme figures of the extreme abandonment, which I wastalking about, the “camp”, respectively the “jungle” are not just twins (evenSiamese twins, because they internally communicate), but also perfectly, rigorouslycomplementary from the point of view of their capacity of expressingneatly the only two exclusive alternative possibilities available for every suchdeserted child (when the chance of an adoption didn’t present for him): eitherthe “institutionalisation”, or the street. (However, most of them oscillatebetween the only two “options”, even today when, by different efforts of thecommunity the old orphanage, the prison-like one, was mostly replaced bythe more welcoming “receiving centres”.) But what we also have to remark isthat these two twin figures draw, in their reciprocal relation, a kind of Janusbifrons. If the “camp” points clearly to the past, the “jungle” belongs, as contribution,exclusively and inalienably to the post-communist times.There’s no doubt that we will still find out about cases of children fallingvictims of bad treatments from their own parents, that there will always bemothers who desert their babies under various reasons, sometimes reallyimplacable, that the press won’t fail to report about intolerable abuses againstchildren, within the family or not. And, after all, any exaction, abuse or abjectionto which a child is subjected by those he depends upon (affectively, existentially,materially), literally or by consequences, is a form of abandoninghim, of pushing him in a situation which crushes him, mutilates him, denieshim. (The same way as, at the other end – and only to suggest the delicatethreshold from which the excess of abandonment, as irreparable neglect,starts –, to credit, in a foolish, unlimited manner, the child’s “savage” subjectivity,incomplete by definition, its in-form desires, is irresponsible as well.)But to focus exclusively – and rather voyeuristically – on such strident, tackycases of child’s desertion (serious indeed, but for which, in one way or another,there are legal and practical means of urgently intervening) means toblindfold ourselves with regard to a mainstream course of things, which isalready common in the everyday life of most urban families. All the morewhen people are better, more “successful” (more passively) integrated – effectivelyor through their aspirations to a life “style”, to a certain level of consumingeverything they can be sold for their money (even on credit), from dreamsof happiness, personal or “with the loved ones”, to “(packed) services”, by allmeans “professionalized”, of parental, pedagogic, educative, recreationalassistance/substitution – by the society shaped as it is, in like manner aseverywhere, by those forces and trends who, on the whole, and in Romania,116

A course of things which, if is to be provento allow no recourse whatsoever (and it does become more and more difficultto surpass at a strictly individual, private level, as it largely implies structuraltrends), could mean a really disturbing anthropological (cultural, societal) shift.It’s knocking at our door from the future – our children’s children future, delivered,exposed ever more unprotected to the instances which benevolentlyoffer to replace us in their lives (for instance, directly addressed advertising,marketing campaigns in schools, under the most virtuous pretences, includingcovert religious or moralizing propaganda using the same methods, multimediacontents especially projected by entertainment industries and so forth).And it will indeed be unavoidable if the alibis we more often find (with the bestintention, of course) for our resignations and defects, as well as the compensatory(because diffusely culpable) outbids for the “spoils” those same benevolentinstances so generously offer, in fact a flight ahead in this kind of abandonment,will get to blur our view. An important social contractual relation, decisive in our modernsocieties, is also the salary’s social-economic one (relation between capitaland labour) or, at the other extreme end of the social-economic field andgaining a strategic significance – through its consequences – at the presenttime, the relation between the global shareholder stuff of a multinationalcompany, namely its executive board, and the local societies wherein itsactivities are crucial. And let’s not forget another important element of thepicture, the propriety itself (the attribute “private” is quasi-pleonastic here);inasmuch as it is a condensate of the history of some social relations andthus a result of the same kind, it takes part, too, in the social contract’sdevice, and this in a twofold manner: first as a logical-transcendental presuppositionof it, and, secondly, as a limit to the social-logical field empiricallysubtended by the meaning of such a contract.2. For the juridical order consubstantial to such a foundation, the subject ofthe law has no age and, as a matter of fact, no other natural characteristicpre-existent to this order; so, before the law, and in principle, the subjectshave no gender, no race, no ethnicity (which is different from nationality),etc. This argument is extrapolated then in order to guarantee “special”rights for the handicapped, for the mentally ill, etc. (in fact a law “supplement”meant to redress, by making them equal before the law, the contingencyof natural inequality); then by another analogous derivation of thesame argument, law stipulations as “positive discrimination”, etc., can bejustified. Today we can see that the de facto limit where this logic stumblesconsists of the situations wherein the legislator looks for “support and light”from the debates falling, by all means, under the head of bioethics. This isthe reflexive instance where they literally ask the question of when does thesubject come into the world (at his birth or before? and for how long before?– with regard to the debates concerning the ethical-juridical aspects ofabortion, those related to the genetically assisted procreation, the embryoresearch, the therapeutic cloning, etc.), and when does it end (dilemmas ofeuthanasia). However, the bioethical reflection doesn’t have another guidingconcept of subject but that already equivalent to its old modern metaphysicalsense, with its juridical and ethical-political applications.3.
