We sit looking over the fence, watchers at the bordersturning our back to the inland where, in the absence of any kind of politics,only improvisation, the spasmodic reaction to the immediate can dominate.Uncultivated and untamed, even in terms of bio-politics, after the short andcatastrophic communist experiment, the underdeveloped Romanian societydoesn’t produce normally (and according to norms, normalizing) individualsand populations but only margin (in the double meaning of marginality andextreme) pathologies without standard, epiphenomenona without phenomenonof the social engineering and the art of governance. The Shepherd isa sheep himself, having several sheepskins under the butt and on the backs,nothing more. Human agriculture politically unindustrialized. From the politicalontology viewpoint, the Romanian anthropogenesis hasn’t reached theman yet. In Romania, the nature isn’t cultivated, isn’t tamed, isn’t civilized,the living is not even, catastrophically, manipulated. Immanence withouttranscendence cannot make camps, the battle doesn’t take place: history– inside – hasn’t started yet. Only the whirls and commotions of the exteriorworld force us to falsely heroic individuations, but without individuals, withoutproducts of some politics, in the absence of any other endogenesis thanthe simple shadows of an exterior always perceived negatively through thefences.Fetal SocietyIn La condition foetale. Une sociologie de l’engendrement et de l’avortement(Gallimard, 2004), Luc Boltanski talks about the social invisible, unborn, inexistentand unconstituted, in the (implicit) categorial sense, that sociology,in the line of Durkheim-Bourdieu, has to deliver. The visible, obvious,frequented social objects, especially when they are (hyper)focalized and, ofcourse, media framed (reads: supra-phenomenalization), are “bad objectsfor a sociologist”. Through “distanciation”, “axiological neutrality” and“modelization”, the authentic sociology has to elaborate pertinent studyobjects. In today Romania, to preliminary political abandon (functioning asthe very condition of social constitution) corresponds naturally not the resignation,which would presuppose an active antecedent, but the unconstituionas such of the social function of sociology as investigation-critical phenomenalizingdiscipline. In Romania, the profession of sociologist has been reducedabusively and comfortably, criminally, from the inside of the discipline,to that of “pole analyst” under contract with the immediately reactive politics.We live, socially and sociologically consolidated, in vague, in unformulated,in preexistent, in larval. To the social unconstitution, even with the unfortunateforceps of bio-politics, corresponds without trouble the sociologicalnon-elaboration. Or, without object, no chance for a subject. Without knowledge,no fight. Much ado about nothing.Asepticized, medicalized, technicized, birth and abortion presuppose andhave developed in western societies grammar techniques to avoid, to nonobjectivization,demonstrates Boltanski. Thus, he speaks, methodologically,about the “difference between the components of the social world that, atsome point, are overexposed and those that, without being totally unknown,144

Fætul-proiect este vizualizat tehnic,mama-mediu dialogheazæ cu el, el nu este nicio clipæ un necunoscut, fiindcomplet predeterminat. Evenimentul noului, cum ar spune Derrida, esteperfect conjurat, socializat.La polul opus, dar în interiorul aceleiaøi scheme øi prin intermediul aceleiaøitehnici generale de preîntîmpinare –, fætul tumoral. Øi el este elaborat, constituitobiectual, dar nu în direcflia fiinflei, ci în cea a neantului, conform alteidirecflii implicit „gramaticale“. El nu mai este însæ „aspirat cætre viitor“, asemenifætului-proiect creat înainte de a fi fost procreat, ci este „tras înapoi spreneantul din care abia a ieøit“: „proiectul“ care-l priveøte este ca el sæ lase cîtmai pufline urme posibil, inclusiv øi mai ales în memorie. Avortul trebuie cudesævîrøire øi imediat uitat. „Se face absolut totul pentru a se investi cît maipufline reprezentæri cu putinflæ în el.“ E conceput – pozitivare malignæ a negativului– ca o tumoare, corp stræin care vine sæ afecteze negativ, ameninflætor,dat fiind cæ ascultæ de o „logicæ oarbæ“, corpul propriu. Avortul este privitca o operaflie, ca o intervenflie chirurgicalæ. Avortul medicalizat aseptizeazæ,neutralizeazæ definitiv avortul clandestin: noul corp dispare cu desævîrøireînainte chiar de a fi apucat sæ aparæ, øi tocmai pentru a nu mai apuca sæ aparæ.Mai mult, mai pregnant chiar: el nu e nimic, nu apucæ sæ fie constituit în ordineaexistentului, nu i se îngæduie accesul nu numai la umanitate, ci øi lamemoria personalæ. „Traumatismul naøterii“ nu trebuie sæ se producæ nicimæcar în ordinea negativului. Fætul-tumoare e invizibil: nu intræ în „obiectivitatealumii“. Fiinflæ-nihil, eliminatæ terapeutic ca boalæ øi ca însæøi adiere animicului, fætul tumoral este forclus printr-un limbaj perifrastic care evitæ fieøi doar sæ-l obiectualizeze, sæ-l în-fiinfleze verbal. E nonobiect øi nonsubiect.În plus, tehno-fætul manifestæ capacitatea magicæ a tehnicii de a media-evitatraumatismul, pozitivat sau negativizat, al naøterii øi în ordinea lucrurilor, darøi în cea a cuvintelor. Carnea øi memoria proprii ale persoanei ræmîn astfelneafectate de acest eveniment-incident.Or, în atari condiflii, cum ar putea drepturile omului sæ priveascæ, sæ acopereceva ce nici nu apucæ sæ fie om? Deconstructiv vorbind, ce este, unde este,pînæ unde este umanul? Însæøi conceperea ca atare, prin secflionare, prindesprindere, a drepturilor copilului distruge, restrînge fatal sfera drepturiloromului, ale umanului.Fiinflæ cu „poziflie ambiguæ“, fætul „destabilizeazæ separaflia categorialæ dintrefætul autentic øi fætul tumoral“. Øi aceasta deopotrivæ în ordinea reprezentærii,în cea a vizibilitæflii øi în aceea a experienflei corporale.remain ignored however as if there is a tacit agreement about them to shutthe eyes”. Consequently, the phenomenon of “social ill-faith”, of “separationbetween what is officially known and officiously known or, in other words, themode of tacit knowledge”. Such an approach that distinguishes “the momentswhen we open our eyes and those when we shut them” qualify the “moralsociology”, which studies the “avoiding procedures” and analyzes “the socialdevices meant to attenuate or to circumvent certain contradictions”.Analyzing the occultations, so the implicit categories according to which thewestern societies think (or not) the apparition of the living, in other words:the way in which they phenomenalyze the phenomenon par excellence:birth and the living reproduction of life –, Boltanski establishes a basic opposition:fetus-project versus fetus-tumor.The fetus-project is the authentically emphasized fetus, the object, even thesubject, the “pre-subject” of a programmed “birth through project”.The unborn is anticipated even before conception, it is the “already baby”,already a person: pre-individualization. It is expected, the family not onlytalks about it but with it, the whole family microcosm is being reorganized,messianically-secularized, for its coming as it pleases. The fetus-project istechnically visualized, the mother-environment dialogs with it, it isn’t anunknown at any moment as it is totally predetermined. The event of the new,as Derrida would say, is perfectly conjured, socialized.At the other end, but within the same structure and through the same generaltechnique of anticipated, there is the fetus-tumor. It is elaborated too,objectually constituted, not toward the being but toward the nothingness,according to another implicitly “grammatical” direction. It is not “aspiredto the future”, like the fetus-project created before procreation, but “drawnback to the nothingness its just came from”: the “project” about it is to leaveas few traces as possible, including and especially in memory. The abortionneeds to be forgotten totally and immediately. “Everything is done to investit with the least possible representations.” It is conceived – malignant pozitivationof the negative – as a tumor, a foreign body that comes to influencenegatively, menacingly, because it obeys “blind logics”, the body proper.The abortion is seen as an operation, as surgery. The medicalized abortionasepticizes, neutralizes definitively the clandestine abortion: the new bodydisappears completely even before it appeared and precisely in order not toappear. Moreover, it is nothing, it has no time to be constituted as existent,it has no access to humanity or personal memory. The “trauma of birth” mustn’thappen, not even in a negative sense. The fetus-tumor is invisible: it doesn’tget into the “world objectivity”. Being-nihil, therapeutically eliminated asdisease, as the light touch of the nothingness, the fetus-tumor is foreclosedthrough a periphrastic language avoiding to name it as an object, to makeit be in speech. It is non-object and non-subject.Moreover, the techno-fetus manifests the magical capacity of technologyto mediate/avoid the traumatism, either positively or negatively invested,of birth in the world or in language. The very own flesh and memory of theperson are unaffected by this event-incident.Or, under such circumstances, how can human rights concern, cover somethingwhich is not even human? Speaking in the terms of deconstruction,what is, where is, how far human goes? The <strong>idea</strong> of children’s rights as such,sectioned, unfolded, destroys, restricts fatally the sphere of human rights,of the human.Being with an “ambiguous position”, the fetus “destabilizes the categoricalseparation between the authentic fetus and the tumoral fetus” both in theorder of representation, visibility and bodily experience.145
