g. The committee shall judge the relevancy and weight<br />

<strong>of</strong> testimony and evidence. It shall make its findings<br />

on fact and limit investigation to the formal charge.<br />

It shall also make a recommendation for disposition<br />

<strong>of</strong> the charge to the college President. Actions in this<br />

procedure shall be completed within five working<br />

days.<br />

h. The committee shall submit its findings <strong>of</strong> fact<br />

and recommend action to both parties and to the<br />

President <strong>of</strong> the college. Upon receipt <strong>of</strong> the findings<br />

and recommendations, the President <strong>of</strong> the college<br />

shall:<br />

(1) concur with the committee’s recommendation.<br />

(2) not concur with the committee’s recommendation.<br />

(3) take alternative action.<br />

(4) state in writing the reasons for the action taken<br />

on the committee’s recommendation. The<br />

President shall act within ten working days.<br />

i. If either party does not agree with the decision <strong>of</strong><br />

the college president at this time, an appeal may<br />

be made to the Chancellor <strong>of</strong> the <strong>Ventura</strong> County<br />

Community <strong>College</strong> District.<br />

j. If he/she is still dissatisfied with the decision, an<br />

appeal may be made to the Governing Board who<br />

shall render the final decision.<br />

k. Records <strong>of</strong> all proceedings shall be maintained by<br />

the college President in accordance with rules <strong>of</strong><br />

confidentiality and board/state/federal laws, rules,<br />

regulations and contracts. Insertion <strong>of</strong> information<br />

regarding a case in employee’s personnel records<br />

will only be made in compliance with board/state/<br />

federal laws, rules, regulations and contracts.<br />

APPENDIX III<br />

Privacy Rights Governing Student Records<br />

Pursuant to the Federal Educational Rights and Privacy Act<br />

(FERPA), the California Education Code (§76240 et. seq.) and<br />

the California Administrative Code Title 5, the colleges <strong>of</strong> the<br />

<strong>Ventura</strong> County Community <strong>College</strong> District establish and maintain<br />

information on students relevant to admission, registration, academic<br />

history, career, student benefits or services, extra-curricular<br />

activities, counseling and guidance, discipline or matters related to<br />

student conduct, and shall establish and maintain such information<br />

required by law. All such records are maintained under the direction<br />

<strong>of</strong> the Dean <strong>of</strong> Student Services.<br />

The colleges <strong>of</strong> this District maintain directory information<br />

which may be released to the public without the written consent<br />

<strong>of</strong> the student. Directory information may include: student's name;<br />

address; telephone number; date-<strong>of</strong>-birth; major field <strong>of</strong> study;<br />

participation in <strong>of</strong>ficially recognized activities and sports, dates<br />

<strong>of</strong> attendance; degrees and awards received; and the most recent<br />

educational institution attended by the student; and weight and<br />

height <strong>of</strong> members <strong>of</strong> athletic teams.<br />

Directory information will be released to branches <strong>of</strong> the<br />

United States military services in compliance with the Solomon<br />

Act, the National Student Clearinghouse, and may be released to<br />

other parties in accordance with the Education Code §76240. No<br />

directory information shall be released regarding any student or<br />

former student who has notified the District or any college there<strong>of</strong><br />

in writing that such information shall not be released. Such requests<br />

shall be addressed to the Dean <strong>of</strong> Student Services.<br />

The college will forward a student's educational records to other<br />

institutions <strong>of</strong> higher education that have requested the records<br />

and in which the student seeks or intends to enroll, providing such<br />

release <strong>of</strong> educational records complies with the requirements <strong>of</strong><br />

FERPA.<br />

FERPA affords students certain rights with respect to their<br />

education records. These rights include:<br />

(1) The right to inspect and review the student’s education record<br />

within 15 working days <strong>of</strong> the day the <strong>College</strong> receives a request<br />

for access.<br />

Students should submit to the Registrar written requests that<br />

identify the record(s) they wish to inspect. The <strong>College</strong> <strong>of</strong>ficial will<br />

make arrangements for access and notify the student <strong>of</strong> the time<br />

and place where the records may be inspected.<br />

If the records are not maintained by the <strong>College</strong> <strong>of</strong>ficial to whom<br />

the request was submitted, that <strong>of</strong>ficial shall advise the student <strong>of</strong><br />

the correct <strong>of</strong>ficial to whom the request should be addressed.<br />

(2) The right to request the amendment <strong>of</strong> the student’s education<br />

records that the student believes is inaccurate.<br />

A student may ask the <strong>College</strong> to amend a record that he or<br />

she believes is inaccurate. Such request shall be made in writing<br />

to the registrar, clearly identify the part <strong>of</strong> the record they want<br />

changed, and specify why it is inaccurate.<br />

If the <strong>College</strong> decides not to amend the record as requested<br />

by the student, the <strong>College</strong> will notify the student <strong>of</strong> the decision<br />

and advise the student <strong>of</strong> his or her right to appeal regarding the<br />

request for amendment. Additional information regarding the appeal<br />

procedures will be provided to the student when notified <strong>of</strong> the<br />

right to a hearing.<br />

(3) The right to consent to disclosures <strong>of</strong> personally identifiable<br />

information contained in the student’s education records, except<br />

to the extent that FERPA authorizes disclosure without consent.<br />

One exception, which permits disclosure without consent, is<br />

disclosure to school <strong>of</strong>ficials with legitimate educational interests.<br />

A school <strong>of</strong>ficial is a person employed by the <strong>College</strong> District in<br />

an administrative, supervisory, academic or research, or support<br />

staff position (including law enforcement unit personnel and health<br />

staff); a person or company with whom the <strong>College</strong> District has<br />

contracted (such as an attorney, auditor, or collection agent); a<br />

person serving on the Board <strong>of</strong> Trustees; or a person serving on an<br />

<strong>of</strong>ficial committee, such as a disciplinary or grievance committee,<br />

or assisting another school <strong>of</strong>ficial in performing his or her tasks.<br />

A school <strong>of</strong>ficial has a legitimate educational interest if the <strong>of</strong>ficial<br />

needs to review an education record in order to fulfill his or her<br />

pr<strong>of</strong>essional responsibility. In compliance with California Education<br />

Code §76222, a log or record shall be maintained <strong>of</strong> persons,<br />

agencies or organizations requesting and receiving information<br />

from a student record. Also pursuant to code, such log or record<br />

will not include the following:<br />
