Territorial context of the project<br />

The fourth zone, between highway 132 and the river, is designated as rural. Housing<br />

is authorized, as are office buildings and various services. A technical corridor<br />

destined to link the industrial facilities to port facilities is authorized in both zones. The<br />

fifth zone, in the river, stretches over about 1.5 km to the west from the Beaumont<br />

limit. Port facilities, marine terminals, and various types of industry are permitted<br />

there.<br />

The project site is also protected by the Act respecting preservation of agricultural<br />

land and agricultural activities. Almost all the land is, in fact, in an agricultural zone,<br />

the “green zone” established under the Act. The construction of the LNG terminal land<br />

facilities is thus subject to a decision by the Commission de protection du territoire<br />

agricole du Québec (CPTAQ). On this issue, the City of Lévis adopted a resolution<br />

regarding the request to exclude part of this land from the agricultural zone and this<br />

resolution must be forwarded to the CPTAQ for the project to go ahead (DB109). The<br />

agricultural status of the site was invoked several times during the public hearing,<br />

particularly in relation to tree-growing activities. However, no specific claims have<br />

been made regarding the land by farmers or farmers unions.<br />

♦ Finding — The Panel found that the land use planning and development plan, the<br />

Master Plan, and the zoning by-law that apply to the site retained for the project<br />

facilities includes both existing uses as well as industrial and port activities with the<br />

corresponding categories of authorized uses.<br />

♦ Finding — The Panel found that the project, diverges, by its nature from current land<br />

uses in the Ville-Guay sector.<br />

♦ Finding — The Panel found that the site retained for the project facilities is part of<br />

the agricultural zone protected under the Act respecting preservation of agricultural<br />

land and agricultural activities. For this reason, the Commission de protection du<br />

territoire agricole du Québec will have to make a decision on the request to exclude<br />

part of the agricultural zone to enable the project to go ahead.<br />
