FEDERAL DISCLOSURE REQUIREMENTS<br />

According to federal law, institutions of higher education must<br />

provide the following consumer information to students:<br />

A. Financial Assistance Information<br />

1. How the eligibility for student financial aid is determined<br />

2. How the institution distributes aid among students<br />

3. Rights and responsibilities of students receiving aid<br />

4. How and when financial aid will be disbursed<br />

5. The terms and conditions of any employment that is part of the<br />

financial aid package<br />

6. The terms of, the schedules for, and the necessity of loan<br />

repayment<br />

7. Required loan exit counseling<br />

8. The criteria for measuring satisfactory academic progress, and how<br />

a student who has failed to maintain satisfactory progress may<br />

reestablish eligibility for financial aid<br />

B. Information about the Institution<br />

1. The names of associations, agencies and/or governmental bodies<br />

that accredit, approve or license the school and its programs, and the<br />

procedures by which a student may receive a copy for review of the<br />

school’s accreditation, licensure, or approval<br />

2. Special facilities and services available to disabled students<br />

3. A statement of the requirements for the return of Federal Student<br />

Aid program funds when a student withdraws from school,<br />

information about any refund policy with which the school must<br />

comply, and the requirements for officially withdrawing from the<br />

school<br />

4. The availability of a General Equivalency Diploma (GED)<br />

program if the school admits students who do not have a high school<br />

diploma or equivalent<br />

5. Who to contact for information on student financial assistance and<br />

who for general institutional issues<br />

6. That a student may be eligible for Federal Student Aid program<br />

funds for attending a study abroad program that is approved for credit<br />

by the home school<br />

7. The terms and conditions under which students receiving federal<br />

education loans may obtain deferments while serving (a) in the<br />

Peace Corps; (b) under the Domestic Volunteer Service Act; and (c)<br />

as a volunteer for a tax-exempt organization of demonstrated<br />

effectiveness to the field of community service<br />

8. Information regarding the availability of Federal Student Aid<br />

program funds for study abroad programs<br />

INSTITUTIONAL COMPLAINT PROCESS<br />

Section 494C(j) of the Higher Education Act of 1965, as amended,<br />

provides that a student, faculty member, or any other person who<br />

believes he or she has been aggrieved by an institution of higher<br />

education has the right to file a written complaint.<br />

In New York State, a complaint may be filed by any person with<br />

reason to believe that an institution has acted contrary to its published<br />

standards or conditions or that conditions at the institution appear to<br />

jeopardize the quality of the institution’s instructional programs or<br />

the general welfare of its students. Any person who believes that he<br />

or she has been aggrieved by an institution on or after May 4, 1994,<br />

may file a written complaint with the department within three years<br />

of the alleged incident.<br />

How to File a Complaint<br />

1. The person should first try to resolve the complaint directly with<br />

the institution by following the internal complaint procedures<br />

provided by the institution. An institution of higher education is<br />

required to publish its internal complaint procedure in a primary<br />

information document such as the catalog or student handbook. (The<br />
