The Administrative ArrangementsThe structure of <strong>the</strong> ACTPS is determined by <strong>the</strong> <strong>Chief</strong> <strong>Minister</strong> in accordance with <strong>the</strong>provisions of <strong>the</strong> Australian Capital Territory (Self-Government) Act 1988 (Cwlth)(<strong>the</strong> Self Government Act) <strong>and</strong> <strong>the</strong> Public Sector Management Act 1994 (<strong>the</strong> PSM Act). It isformally recorded in <strong>the</strong> Administrative Arrangements through which responsibility forlegislation is assigned to <strong>Minister</strong>s, ACTPS Administrative Units are established, <strong>and</strong> <strong>Chief</strong>Executives are placed in control of those Administrative Units. The appointment of <strong>Minister</strong>sto <strong>the</strong>ir various portfolios by <strong>the</strong> <strong>Chief</strong> <strong>Minister</strong> under <strong>the</strong> Self Government Act is formalisedin a separate Instrument, <strong>the</strong> Australian Capital Territory (Self-Government) <strong>Minister</strong>ialAppointment (of which 2009 No.3 is <strong>the</strong> current version). 175The single ACTPS model described in Chapter 3 means that <strong>the</strong>re would formally be onlyone Administrative Unit (in <strong>the</strong> current terminology). Functions <strong>and</strong> legislation would,however, continue to be allocated to <strong>Minister</strong>s <strong>and</strong> <strong>Directorate</strong>s to maintain transparency ofresponsibility, <strong>and</strong> accountability for results.Section 7 of <strong>the</strong> PSM Act sets out <strong>the</strong> principles under which <strong>the</strong> ACTPS is administered(emphasis added):The public sector shall be administered with an objective of giving effect to <strong>the</strong> followingprinciples:(a) <strong>the</strong> public sector shall be administered to provide quality services to <strong>the</strong>public;(b) decisions shall be as fair as possible;(c) <strong>the</strong> best management practices shall be used;(d) <strong>the</strong> public sector shall be structured <strong>and</strong> organised to facilitate <strong>the</strong> timely<strong>and</strong> effective performance of its functions;(e) <strong>the</strong>re shall be a clear <strong>and</strong> explicit delineation of <strong>the</strong> responsibilities <strong>and</strong>accountabilities of public employees, administrative units <strong>and</strong> territoryinstrumentalities;(f) <strong>the</strong> public sector shall be managed in accordance with principles of access<strong>and</strong> equity by giving all members of <strong>the</strong> public <strong>the</strong> opportunity to have a fairare of <strong>the</strong> resources which <strong>the</strong> Territory manages on <strong>the</strong>ir behalf <strong>and</strong> anopportunity to gain access to <strong>the</strong> resources to which <strong>the</strong>y are entitled;(g) <strong>the</strong> public sector shall be administered to minimise <strong>the</strong> possibility ofunlawful discrimination.175 See http://www.legislation.act.gov.au/ni/2009-594/default.aspAdministrative Arrangements Changes: 108
