A fur<strong>the</strong>r implication of <strong>the</strong> current fragmentation is <strong>the</strong> fact that <strong>the</strong> ACTPS competesagainst itself to staff duplicated functions instead of locating skilled staff in coherentorganisational units with a critical mass of <strong>the</strong>ir own.In fulfilling its functions, ACTPLA delivers professional services including:• planning for <strong>the</strong> future development <strong>and</strong> growth of <strong>the</strong> ACT;• assessing development proposals <strong>and</strong> overseeing construction activity;• maintaining l<strong>and</strong> <strong>and</strong> geographical information; <strong>and</strong>• facilitating opportunities for input into shaping Canberra’s built environment.ACTPLA currently reports to one <strong>Minister</strong>:<strong>Minister</strong> Portfolio FunctionsAndrew Barr MLA <strong>Minister</strong> for Planning Electricity <strong>and</strong> natural gas, water <strong>and</strong> sewerageindustry technical regulationOccupational licensingPlanning, development <strong>and</strong> building controlSurvey <strong>and</strong> leasingACTPLA was established in August 2003. In October 2003 it was declared anAdministrative Unit to ensure budgetary independence during its separation from <strong>the</strong>Department of Urban Services.The functions of <strong>the</strong> ACT Planning <strong>and</strong> L<strong>and</strong> Authority are set out under section 12 ofPlanning <strong>and</strong> Development Act 2007 (<strong>the</strong> Planning Act): 229(1) The planning <strong>and</strong> l<strong>and</strong> authority has <strong>the</strong> following functions:(a) to prepare <strong>and</strong> administer <strong>the</strong> territory plan;(b) to continually review <strong>the</strong> territory plan <strong>and</strong> propose amendments asnecessary;(c) to plan <strong>and</strong> regulate <strong>the</strong> development of l<strong>and</strong>;(d) to advise on planning <strong>and</strong> l<strong>and</strong> policy, including <strong>the</strong> broad spatialplanning framework for <strong>the</strong> ACT;(e) to maintain <strong>the</strong> digital cadastral database under <strong>the</strong> Districts Act 2002;(f) to make available l<strong>and</strong> information;(g) to grant, administer, vary <strong>and</strong> end leases on behalf of <strong>the</strong> Executive;(h) to grant licences over unleased territory l<strong>and</strong>;(i) to decide applications for approval to undertake development;(j) to regulate <strong>the</strong> building industry;(k) to make controlled activity orders under part 11.3 (Controlled activityorders) <strong>and</strong> take o<strong>the</strong>r compliance <strong>and</strong> enforcement action under thisAct <strong>and</strong> o<strong>the</strong>r territory laws;229 See http://www.legislation.act.gov.au/a/2007-24/default.aspAdministrative Arrangements Changes: 183
