where ORS’s current tobacco related functions came from, <strong>and</strong> which regulates <strong>and</strong> operatescurrently in many of <strong>the</strong> same venues as ORS inspectors. While both <strong>the</strong>se options werecanvassed with <strong>the</strong> Review, it is recommended effort be focussed on embedding <strong>and</strong>unlocking <strong>the</strong> synergies between current functions <strong>and</strong> those proposed to be added now,before fur<strong>the</strong>r change is contemplated.Road Safety Policy <strong>and</strong> Transport RegulationThe Review recommends current TAMS responsibilities for policy in relation to drivercompetency <strong>and</strong> road safety be transferred to Justice. There is significant alignment withcurrent responsibilities in this proposal given <strong>the</strong> close synergies with <strong>the</strong> role of AFP ACTPolicing in providing advice on, <strong>and</strong> enforcing laws in this area. In part, this reflects <strong>the</strong> needto relocate functions that do not fit <strong>the</strong> municipal services focus of TAMS in <strong>the</strong> proposedstructure.This functional area of TAMS responsible for regulation of transport licensing, vehicles <strong>and</strong>public transport should be transferred to ORS. Transport regulation is responsible for <strong>the</strong>largest ACT revenue based system (rego.act) <strong>and</strong> its accompanying regulatory operations.A recent audit of ACTION bus services undertaken by <strong>the</strong> Auditor-General demonstrated <strong>the</strong>risk of having public passenger services regulated in <strong>the</strong> same entity that contains <strong>the</strong> publictransport operator. In her report <strong>the</strong> Auditor-General found:The delivery of bus services <strong>and</strong> associated infrastructure is a complex arrangementinvolving ACTION, o<strong>the</strong>r business units within TAMS (particularly, Roads ACT <strong>and</strong>Transport Regulation <strong>and</strong> Planning) <strong>and</strong> o<strong>the</strong>r ACT Government agencies such asACTPLA. The various activities were not well coordinated <strong>and</strong> lacked properplanning. 200Aligning <strong>the</strong> regulatory functions for transport with o<strong>the</strong>r regulatory services would assist inovercoming <strong>the</strong>se issues.Construction <strong>and</strong> Occupational LicensingThe Construction Occupations Registrar regulates <strong>the</strong> building industry, audits <strong>the</strong> work ofconstruction occupations, investigates complaints against <strong>and</strong> disciplines constructionoccupation professionals, <strong>and</strong> oversees inspection of building, electrical, plumbing, drainage<strong>and</strong> gas-fitting work.The Seamless National Economy licensing proposals will bring toge<strong>the</strong>r some professionslicensed by ACTPLA with those licensed by ORS. The Office for Fair Trading, within ORS,also receives many complaints about <strong>the</strong> building industry perhaps reflecting that industry in<strong>the</strong> ACT has accepted <strong>the</strong> ORS model to provide a ‘one stop shop’ for regulatory matters.Both New South Wales <strong>and</strong> South Australia have <strong>the</strong> Construction <strong>and</strong> Occupation Licensing200 ACT Auditor-General (2010a) Auditor-General Report No. 5 of 2010, Delivery of ACTION Bus Services.
