The client disclosed information which was against its interest in the unrelated matter. The client believed she was safe because she was seeking the lawyer’s advice withregard to workers' compensation matters but, also because he was “her attorney.”When the matter later became the subject of an employment law claim, much to thedismay of the corporate client, the workers' compensation lawyer was called as awitness for the plaintiff. The judge ruled that the disclosure made by the client was notprotected because the workers' compensation attorney was asked to provide advice onthe matter before the Court, thus, the privilege did not apply.
