210Chapter 8 – Profession of Dental Hygiene2. That section 5(3) of the Dental Hygiene Act, 1991 be repealed <strong>and</strong> thefollowing substituted:Grounds for misconduct(3) In addition to the grounds set out in subsection 51(1) of the <strong>Health</strong><strong>Professions</strong> Procedural Code, a panel of the Discipline Committeeshall find that a member has committed an act of professionalmisconduct if the member contravenes subsection (1), (2) or (2.1).3. That section 12 of the Dental Hygiene Act, 1991 be repealed <strong>and</strong> thefollowing substituted:Regulations12. Subject to the approval of the Lieutenant Governor in Council <strong>and</strong>with prior review by the Minister, the Council may make regulations,(a) regulating the prescribing, dispensing, selling or compoundingof drugs by members, requiring members to keep prescribedrecords <strong>and</strong> to provide to the Minister reports containingprescribed information respecting the prescribing, dispensing,selling or compounding of drugs;(b) prescribing requirements for performing scaling teeth <strong>and</strong> rootplaning, including curetting surrounding tissue, whichrequirements may include the educational <strong>and</strong> experientialqualifications that must be obtained in order for a member toundertake those procedures on the member’s own initiative;<strong>and</strong>(c) prescribing contraindications to a member performing orcontinuing to perform on the member’s own initiative theprocedures of scaling teeth <strong>and</strong> root planing, including curettingsurrounding tissue.4. That Ontario Regulation 218/94 under the Dental Hygiene Act,1991(General) be amended by adding the following sections:12.1(k.1) any drug prescribed, dispensed, sold or compounded forthe client.39. (a) For the purposes of this section, “Drug List” has the meaninggiven to it in the Regulated <strong>Health</strong> <strong>Professions</strong> Act, 1991.(b) A member may prescribe, dispense, sell or compound thefollowing classes of drugs:i Anti-infectives-– miscellaneousii Miscellaneous therapeutic agents – cariostatic agents.HPRAC Critical Links January 2009
