457Chapter 18 – Summary of Proposals for ImplementationCHAPTER 16.PRESCRIBING AND USE OF DRUGS IN THEPROFESSION OF RESPIRATORY THERAPYTo implement these recommendations, the following changes to statutes<strong>and</strong> regulations are proposed:1. That section 4(1) of the Respiratory Therapy Act, 1991 be amended byadding the following paragraph:5. Prescribing oxygen.2. That section 5(2) of the Respiratory Therapy Act, 1991 berepealed <strong>and</strong> the following substituted:Additional requirements for authorized acts5(2) A member shall perform a procedure under the authority ofparagraph 5 of section 4 in accordance with any requirementsprescribed in the regulations made under this Act or under theRegulated <strong>Health</strong> <strong>Professions</strong> Act, 1991.Individual scope of practice for respiratory therapists5(3) A member is responsible for identifying the limits of his or hereducational preparation <strong>and</strong> competencies, <strong>and</strong> for resolvingsituations beyond his or her expertise by consulting with orreferring patients to other health care professionals.Grounds for misconduct5(4) In addition to the grounds set out in subsection 51(1) of the<strong>Health</strong> <strong>Professions</strong> Procedural Code, a panel of the DisciplineCommittee shall find that a member has committed an act ofprofessional misconduct if the member contravenes subsection (1),(2) or (3).3. That the Respiratory Therapy Act, 1991 be amended by adding thefollowing section:Regulations12. Subject to the approval of the Lieutenant Governor inCouncil <strong>and</strong> with prior review by the Minister, the Councilmay make regulations,(a) prescribing procedures for the purpose of paragraph 1 of section 4,<strong>and</strong>(b)regulating the prescribing of oxygen by members,requiring members to keep prescribed records <strong>and</strong>HPRAC Critical Links January 2009
