440Chapter 18 – Summary of Proposals for Implementatione) members of the Ontario College of Pharmacists, approved by theOntario College of Pharmacists.33. The College shall post the following on its website:a) the st<strong>and</strong>ards of practice referred to in section 30; <strong>and</strong>b) a list of those members, who are authorized to perform aprocedure under the authority of paragraph 5 of section 4 of the Actor paragraph 3.1 of section 5.1 of the Act.10. That Ontario Regulation 799/93 under the Nursing Act, 1991(Professional Misconduct) be amended by adding the followingsections:1.1 Exceeding the scope of practice of the profession.11.1 Recommending or providing unnecessary services.11.2 Prescribing, dispensing, selling, compounding or administeringa drug or substance for an improper purpose, or otherwise usingimproperly the authority to prescribe, dispense, sell, compound oradminister drugs <strong>and</strong> substances.11.3 Being subjected to the withdrawal or restriction of rights orprivileges under the Controlled Drugs <strong>and</strong> Substances Act (Canada)or the Food <strong>and</strong> Drugs Act (Canada) or the regulations under eitherof those Acts, unless by the member’s own request.11.4 Contravening, while engaged in the practice of nursing, anyfederal or provincial law or municipal by-law with respect to thedistribution, sale, prescribing or dispensing of any drugs or mixtureof drugs.12.1 Treating or attempting to treat a condition that the memberknew or ought to have known was beyond his or her expertise orcompetence.11. That sections 1, 2, 12, 18 of Ontario Regulation 799/93 under the NursingAct, 1991 (Professional Misconduct) be repealed <strong>and</strong> the followingsubstituted:1. Contravening or failing to maintain a st<strong>and</strong>ard of practice of theprofession.2. Delegating an act set out in section 4 or 5.1 of the Act incontravention of section 5 of the Act, or delegating an act set out inparagraph 3.1 of section 5.1 of the Act.12.
