359Chapter 14 – Profession of PharmacyTo implement HPRAC’s recommendations, the following changes to statutes<strong>and</strong> regulations are proposed:1. That section 3 of the Pharmacy Act, 1991 be repealed <strong>and</strong> the followingsubstituted:Scope of practice3. The practice of pharmacy is the promotion of health <strong>and</strong> theprevention <strong>and</strong> treatment of diseases, disorders <strong>and</strong> dysfunctionthrough the monitoring <strong>and</strong> management of medication therapy;the custody, prescribing, compounding <strong>and</strong> dispensing of drugs;<strong>and</strong> the provision of health care aids <strong>and</strong> devices <strong>and</strong> educationrelated to their use.2. That section 4 of the Pharmacy Act, 1991 be repealed <strong>and</strong> the followingsubstituted:Authorized acts4. In the course of engaging in the practice of pharmacy, a memberis authorized, subject to the terms, conditions <strong>and</strong> limitationsimposed on his or her certificate of registration, to perform thefollowing:1. Dispensing, selling or compounding a drug or supervising thepart of a pharmacy where drugs are kept.2. Skin pricking for the purpose of educating patients on the useof health care aids <strong>and</strong> devices <strong>and</strong> for the purpose ofmonitoring chronic diseases.3. Administering, by injection or inhalation, a substance for thepurpose of patient education or demonstration.4. Prescribing a drug that the member may prescribe under theregulations.3. That the Pharmacy Act, 1991 be amended by adding the followingsections:Additional requirements for authorized acts4.1 A member shall perform a procedure under the authority ofparagraphs 2, 3 or 4 of section 4 in accordance with anyrequirements prescribed in the regulations made under this Actor under the Regulated <strong>Health</strong> <strong>Professions</strong> Act, 1991.4.2 A member shall not perform a procedure under the authority ofparagraph 3 of section 4 unless the substance is prescribed by amember of a College as defined in the Regulated <strong>Health</strong><strong>Professions</strong> Act, 1991 who has the authority to make theprescription.HPRAC Critical Links January 2009
