220Chapter 9 – Profession of Dentistryspecified acts under the supervision or direction of a dentist. With the newauthorities given to dental hygienists in 2007 under the Dental HygienistsAct, 1991, it is HPRAC’s view that the DPRA regulation should be repealed<strong>and</strong> made a regulation under the Dental Hygiene Act, 1991.HPRAC is also making recommendations to update housekeeping mattersrespecting regulations under the DPRA <strong>and</strong> the Dentistry Act, 1991.Recommendations1: That the RCDSO develop, establish <strong>and</strong> maintain st<strong>and</strong>ards of practice forthose procedures performed under the authority of paragraph 7 of section 4of the Dentistry Act, 1991.2: That the RCDSO establish a Dentistry St<strong>and</strong>ards Committee that includesmembers of the College of Physicians <strong>and</strong> Surgeons of Ontario, the Collegeof Nurses of Ontario, <strong>and</strong> the Ontario College of Pharmacists.Implementation ProposalsTo implement HPRAC’s recommendations, the following changes tostatutes <strong>and</strong> regulations are proposed:1. That paragraph 7 of section 4 of the Dentistry Act, 1991 be repealed <strong>and</strong>the following substituted:7. Prescribing, dispensing, selling or compounding a drug.2. That the Dentistry Act, 1991 be amended by adding the followin section:Additional requirements for authorized acts4.1 A member shall perform a procedure under the authority ofparagraph 7 of section 4 in accordance with any requirementsprescribed in the regulations made under this Act or under theRegulated <strong>Health</strong> <strong>Professions</strong> Act, 1991.3. That section 12 of the Dentistry Act, 1991 be repealed <strong>and</strong> the followingsubstituted:Regulations12. Subject to the approval of the Lieutenant Governor in Council<strong>and</strong> with prior review by the Minister, the Council may makeregulations regulating the prescribing, dispensing, selling orcompounding of drugs by members, requiring members to keepprescribed records <strong>and</strong> to provide to the Minister reportscontaining prescribed information respecting the prescribing,dispensing, selling or compounding of drugs.HPRAC Critical Links January 2009
