306Chapter 12 – Profession of Nursing5.2 A nurse practitioner is responsible for identifying the limits ofhis or her education preparation and competencies, and forresolving situations beyond his or her expertise by consultingwith or referring patients to other health care professionals.5. That section 14 of the Nursing Act, 1991 be repealed and the followingsubstituted:Regulations14. (1) Subject to the approval of the Lieutenant Governor inCouncil and with prior review by the Minister, the Councilmay make regulations,(a) prescribing procedures for the purpose of paragraph 1 ofsection 4;(b) permitting a member to perform a procedure under clause5(1)(a) and governing the performance of the procedureincluding, without limiting the foregoing, prescribing the classof members that can perform the procedure and providing thatthe procedure may only be performed under the authority of aprescribed member or a member of a prescribed class;(b.1) regulating the prescribing, compounding, dispensing or sellingof drugs by members, requiring members to keep prescribedrecords and to provide to the Minister reports containingprescribed information respecting the prescribing,compounding, dispensing or selling of drugs; and(c) prescribing the forms of energy that a member may order forthe purpose of paragraph 2 of subsection 5.1(1) and prescribingthe purpose for which, or the circumstances in which, the formof energy may be applied.6. That Ontario Regulation 275/94 under the Nursing Act, 1991 (General) beamended by adding the following section:5(4) It is a term, condition and limitation of a certificate ofregistration of any class that the holder who performs aprocedure under the authority of paragraph 5 of section 4 ofthe Act or paragraph 3.1 of section 5.1 of the Act must ensurethe procedure is performed in accordance with any standardsof practice established and published by the College from timeto time.7. That section 16 of PART III (Controlled Acts) of Ontario Regulation 275/94under the Nursing Act, 1991 (General) be repealed and the followingsubstituted:16(a) For the purposes of this section, “Drug List” has the meaninggiven to it in the Regulated Health Professions Act, 1991.HPRAC Critical Links January 2009
307Chapter 12 – Profession of Nursing(b) A member may prescribe the following classes of drugs underthe authority of paragraph 3 of section 5.1:1. antihistamine drugs,2. anti-infective agents,3. autonomic drugs,4. blood formation, coagulation and thrombosis agents –antithrombotic drugs,5. cardiovascular drugs,6. CNS agents – analgesics and antipyretics – NSAIDs,anticonvulsants, psychotherapeutic agents, antimigraineagents, miscellaneous,7. electrolytic, caloric and water balance,8. enzymes,9. respiratory tract agents,10. eye, ear, nose and throat preparations – anti-infectives,anti-inflammatory agents,11. gastrointestinal drugs,12. hormones and synthetic substitutes – adrenals,contraceptives, estrogens, antidiabetic agents,progestins, thyroid and antithyroid agents,13. local anaesthetics,14. serums, toxoids and vaccines,15. skin and mucous membrane agents,16. vitamins,17. bone resorption inhibitors, and18. emergency medications.(c) A member may only prescribe those drugs within the classesdesignated in subsection 16(b) that are listed in the Drug Listand must prescribe or use those listed drugs in accordance withthe terms, limitations and conditions contained in the Drug List.(d) A member may prescribe or administer any drug or substancethat may lawfully be purchased or acquired without aprescription.8. That section 19 of PART III (Controlled Acts) and Schedules 2 and 3 ofOntario Regulation 275/94 under the Nursing Act, 1991 (General) berepealed.9.
