435Chapter 18 – Summary of Proposals for Implementation- Exceeding the scope of practice of the profession.- Contravening or failing to maintain a st<strong>and</strong>ard of practice of theprofession.- Failing to advise an individual to consult with a physician orother regulated health professional where the memberrecognizes, or ought to recognize, a condition that is beyond thecompetence or experience of the member or that requires suchconsultation to ensure the proper care of the individual.- Treating or attempting to treat a condition that the memberknew or ought to have known was beyond his or her expertise orcompetence.- Practising the profession while the member is in a conflict ofinterest.- Recommending or providing unnecessary services.- Prescribing, dispensing, selling, compounding or using aprescription therapeutic product or drug for an improperpurpose, or otherwise using improperly the authority toprescribe, dispense, sell, compound or use prescriptiontherapeutic products or drugs.- Being subjected to the withdrawal or restriction of rights orprivileges under the Food <strong>and</strong> Drugs Act (Canada) or theregulations under either of those Acts, unless by the member’sown request.- Contravening, while engaged in the practice of naturopathy, anyfederal or provincial law or municipal by-law with respect to thedistribution, sale, prescribing or dispensing of any prescriptiontherapeutic product or drug or mixture of prescriptiontherapeutic products or drugs.- Delegating an act set out in paragraph 3, 5 or 7 of section 4 ofthe Act.9. That section 10 of Ontario Regulation 107/96 under the Regulated <strong>Health</strong><strong>Professions</strong> Act, 1991 (Controlled Acts) be repealed.HPRAC Critical Links January 2009
