409Chapter 18 – Summary of Proposals for Implementationprofession in the course of practicing the profession.That sections 95(1.4), (1.5), (1.6) <strong>and</strong> (1.7) be moved to follow section95(1).10. That sections 95(1.1) through (1.3) be repealed <strong>and</strong> the followingsubstituted:1) The Council may establish st<strong>and</strong>ards of practice of the professionrelating to required education, training, continuing competency,m<strong>and</strong>atory discussion, consultation <strong>and</strong> transfer of care, <strong>and</strong>st<strong>and</strong>ards, limitations <strong>and</strong> conditions relating to the performance ofan act authorized to the profession.2) Without limiting the generality of subsection (1.1), a st<strong>and</strong>ard ofpractice may be limited in its application to specified classesof members or certificates.3) At least 60 days before a st<strong>and</strong>ard of practice is established by theCouncil under subsection (1.1), the Council shall submit a copy ofthe proposed st<strong>and</strong>ard of practice to the Minister, to the Agency <strong>and</strong>to every member for review4) The Agency shall be entitled to circulate a copy of the proposedst<strong>and</strong>ard of practice to other Colleges, health professionals <strong>and</strong>expert advisors.5) If there is no written objection to a st<strong>and</strong>ard of practice by theMinister or by the Agency within 60 days after it is submitted by theCouncil, the st<strong>and</strong>ard is deemed to be established by the Council.6) The Council shall send a copy of each st<strong>and</strong>ard of practice madeunder subsection (1.1) to each member, the Agency <strong>and</strong> theMinistry.7) The Council shall publish all established st<strong>and</strong>ards of practice onthe Internet at a publicly accessible <strong>and</strong> freely available website <strong>and</strong>shall make them available as a document or in any other format, onrequest <strong>and</strong> at cost, to members of the public.8) The st<strong>and</strong>ards of practice of a profession established under thissection shall be interpreted as if they formed part of a regulationmade under the applicable health profession Act.9) Without limiting the generality of subsection (1.1), the Council’spower to establish st<strong>and</strong>ards of practice may be exercised byadopting by reference, in whole or in part <strong>and</strong> with such changes asthe Council considers necessary, any code, st<strong>and</strong>ard or guidelinerelating to st<strong>and</strong>ards of practice of the profession <strong>and</strong> requirecompliance with the code, st<strong>and</strong>ard or guideline as adopted.10) If a st<strong>and</strong>ard of practice so provides, a scientific, administrative ortechnical document adopted by reference shall be a reference to it,HPRAC Critical Links January 2009
