409Chapter 18 – Summary of Proposals for Implementationprofession in the course of practicing the profession.That sections 95(1.4), (1.5), (1.6) and (1.7) be moved to follow section95(1).10. That sections 95(1.1) through (1.3) be repealed and the followingsubstituted:1) The Council may establish standards of practice of the professionrelating to required education, training, continuing competency,mandatory discussion, consultation and transfer of care, andstandards, limitations and conditions relating to the performance ofan act authorized to the profession.2) Without limiting the generality of subsection (1.1), a standard ofpractice may be limited in its application to specified classesof members or certificates.3) At least 60 days before a standard of practice is established by theCouncil under subsection (1.1), the Council shall submit a copy ofthe proposed standard of practice to the Minister, to the Agency andto every member for review4) The Agency shall be entitled to circulate a copy of the proposedstandard of practice to other Colleges, health professionals andexpert advisors.5) If there is no written objection to a standard of practice by theMinister or by the Agency within 60 days after it is submitted by theCouncil, the standard is deemed to be established by the Council.6) The Council shall send a copy of each standard of practice madeunder subsection (1.1) to each member, the Agency and theMinistry.7) The Council shall publish all established standards of practice onthe Internet at a publicly accessible and freely available website andshall make them available as a document or in any other format, onrequest and at cost, to members of the public.8) The standards of practice of a profession established under thissection shall be interpreted as if they formed part of a regulationmade under the applicable health profession Act.9) Without limiting the generality of subsection (1.1), the Council’spower to establish standards of practice may be exercised byadopting by reference, in whole or in part and with such changes asthe Council considers necessary, any code, standard or guidelinerelating to standards of practice of the profession and requirecompliance with the code, standard or guideline as adopted.10) If a standard of practice so provides, a scientific, administrative ortechnical document adopted by reference shall be a reference to it,HPRAC Critical Links January 2009
