305Chapter 12 – Profession of Nursing(1.1) A member shall perform a procedure under the authority ofparagraph 5 of section 4 in accordance with any requirementsprescribed in the regulations.Individual scope of practice for nurses(1.2) A member is responsible for identifying the limits of his or hereducation preparation <strong>and</strong> competencies, <strong>and</strong> for resolvingsituations beyond his or her expertise by consulting with orreferring patients to other health care professionals.Grounds for misconduct(2) In addition to the grounds set out in subsection 51 (1) of the<strong>Health</strong> <strong>Professions</strong> Procedural Code, a panel of the DisciplineCommittee shall find that a member has committed an act ofprofessional misconduct if the member contravenes subsection(1), (1.1) or (1.2).3. That paragraph 3 of section 5.1 of the Nursing Act, 1991 be repealed <strong>and</strong>the following substituted:Authorized acts by certain registered nurses5.1(1) In the course of engaging in the practice of nursing, amember who is a registered nurse <strong>and</strong> who holds anextended certificate of registration in accordance with theregulations is authorized, subject to the terms, conditions<strong>and</strong> limitations imposed on his or her certificate ofregistration, to perform the following acts in addition tothose the member is authorized to perform under section 4:3. Prescribing a drug that the member may prescribe under theregulations.3.1 Selling or compounding a drug that has been prescribed by amember of a College as defined in the Regulated <strong>Health</strong><strong>Professions</strong> Act, 1991 who has the authority to make theprescription.4. That section 5.1 of the Nursing Act, 1991 be amended by adding thefollowing sections:Additional requirements for authorized acts5.1(1.1) A member shall perform a procedure under the authority ofparagraph 3 or 3.1 of section 5.1 in accordance with anyrequirements prescribed in the regulations made under thisAct or under the Regulated <strong>Health</strong> <strong>Professions</strong> Act, 1991.HPRAC Critical Links January 2009
