308Chapter 12 – Profession of NursingPART VSTANDARDS OF PRACTICE30. The College shall develop, establish <strong>and</strong> maintain st<strong>and</strong>ards of practicefor those procedures performed under the authority of paragraph 5 ofsection 4 of the Act or paragraph 3.1 of section 5.1 of the Act.31. The st<strong>and</strong>ards of practice referred to in section 30 shall be developedon the recommendation of the Nursing St<strong>and</strong>ards Committee.32. For the purposes of section 31, the College shall establish the NursingSt<strong>and</strong>ards Committee referred to in section 31 <strong>and</strong> shall appoint themembership of the Nursing St<strong>and</strong>ards Committee, which shall include,at a minimum, one or more:a) members of the Council;b) members of the College (including practitioners <strong>and</strong> educators);c) persons who are not <strong>and</strong> have not been members of the Collegeor of the Council;d) members of the College of Physicians <strong>and</strong> Surgeons of Ontario,approved by the College of Physicians <strong>and</strong> Surgeons of Ontario,who practice family medicine; <strong>and</strong>e) members of the Ontario College of Pharmacists, approved by theOntario College of Pharmacists.33. The College shall post the following on its website:a) the st<strong>and</strong>ards of practice referred to in section 30; <strong>and</strong>b) a list of those members, who are authorized to perform aprocedure under the authority of paragraph 5 of section 4 of theAct or paragraph 3.1 of section 5.1 of the Act.10. That Ontario Regulation 799/93 under the Nursing Act, 1991(Professional Misconduct) be amended by adding the followingsections:1.1 Exceeding the scope of practice of the profession.11.1 Recommending or providing unnecessary services.11.2 Prescribing, dispensing, selling, compounding or administeringa drug or substance for an improper purpose, or otherwiseusing improperly the authority to prescribe, dispense, sell,compound or administer drugs <strong>and</strong> substances.11.3 Being subjected to the withdrawal or restriction of rights orprivileges under the Controlled Drugs <strong>and</strong> Substances Act(Canada) or the Food <strong>and</strong> Drugs Act (Canada) or theregulations under either of those Acts, unless by the member’sown request.HPRAC Critical Links January 2009
