431Chapter 18 – Summary of Proposals for Implementation10. That section 1(7) of Ontario Regulation 858/93 (ProfessionalMisconduct) under the Midwifery Act, 1991 be repealed <strong>and</strong> thefollowing substituted:7. Prescribing or administering drugs or substances for an improperpurpose, or otherwise using improperly the authority to prescribeor administer drugs or substances.11. That Ontario Regulation 858/93 (Professional Misconduct) under theMidwifery Act, 1991 be amended by adding the following sections:16.1 Failing to advise a patient to consult with a physician or otherregulated health professional where the member recognizes, orought to recognize, a condition that is beyond the competence orexperience of the member or that requires such a consultation toensure the proper care of the patient.16.2 Treating or attempting to treat a condition that the memberknew or ought to have known was beyond his or her expertise orcompetence.16.3 Recommending or providing unnecessary services.33. Being subjected to the withdrawal or restriction of rights orprivileges under the Controlled Drugs <strong>and</strong> Substances Act (Canada)or the Food <strong>and</strong> Drugs Act (Canada) or the regulations under eitherof those Acts, unless by the member’s own request.34. Contravening, while engaged in the practice of midwifery, anyfederal or provincial law or municipal by-law with respect to theprescribing of any drug or mixture of drugs.HPRAC Critical Links January 2009
