458Chapter 18 – Summary of Proposals for Implementationto provide to the Minister reports containingprescribed information respecting the prescribing ofoxygen.4. That Ontario Regulation 596/94 under the Respiratory Therapy Act, 1991(General) be amended by adding the following sections:57.1 (1) It is a term, condition <strong>and</strong> limitation of a certificate ofregistration of any class that the member who performs a procedureunder the authority of paragraph 5 of section 4 of the Act must: (a)provide satisfactory evidence of successful completion of a programthat meets approved criteria; <strong>and</strong> (b) ensure the procedureperformed does not exceed the level of training completed.(2) It is a term, condition <strong>and</strong> limitation of a certificate ofregistration of any class that the member who performs a procedureunder the authority of paragraph 5 of section 4 of the Act mustensure the procedure is performed in accordance with anyst<strong>and</strong>ards of practice established <strong>and</strong> published by the College fromtime to time.5. That sections 1(4) <strong>and</strong> 1(7) of Ontario Regulation 753/93 under theRespiratory Therapy Act, 1991 (Professional Misconduct) be repealed<strong>and</strong> the following substituted:4. Delegating a controlled act set out in subsection 27(2) of theRegulated <strong>Health</strong> <strong>Professions</strong> Act, 1991, in contravention of theregulations, or delegating an act set out in paragraph 5 of section 4of the Act.7. Recommending, prescribing, dispensing or selling medical gasesor equipment for an improper purpose or otherwise usingimproperly the authority to recommend, prescribe, dispense or sellmedical gases or equipment.6. That section 1 of Ontario Regulation 753/93 under the RespiratoryTherapy Act, 1991 (Professional Misconduct) be amended by addingthe following paragraphs:1.1 Exceeding the scope of practice of the profession.31. Failing to advise the patient to consult with a physician or otherregulated health professional where the member recognizes, orought to recognize, a condition that is beyond the competence orexperience of the member or that requires such consultation toensure the proper care of the patient.32. Treating or attempting to treat a condition that the memberknew or ought to have known was beyond his or her expertise orcompetence.33. Practicing the profession while the member is in a conflict ofinterest.34. Recommending or providing unnecessary services.HPRAC Critical Links January 2009
