433Chapter 18 – Summary of Proposals for Implementation4(4) In addition to the grounds set out in subsection 51(1) of the<strong>Health</strong> <strong>Professions</strong> Procedural Code, a panel of the DisciplineCommittee shall find that a member has committed an act ofprofessional misconduct if the member contravenes subsections (2)or (3).5. That section 11(d) of the Naturopathy Act, 2007 be repealed.6. That section 11 of the Naturopathy Act, 2007 be amended by addingthe following section:Regulations(f) regulating the prescribing, dispensing, selling or compounding ofprescription therapeutic products or drugs by members, requiringmembers to keep prescribed records <strong>and</strong> to provide to the Ministerreports containing prescribed information respecting theprescribing, dispensing, selling or compounding of prescriptiontherapeutic products or drugs.7. That the regulations to be made under the Naturopathy Act, 2007(General) include the following provisions:- For the purposes of this section, “Designated Drug List” has themeaning given to it in the Regulated <strong>Health</strong> <strong>Professions</strong> Act, 1991.- A member may prescribe, dispense, sell or compound thefollowing classes of prescription therapeutic products as definedunder the Food <strong>and</strong> Drugs Act (Canada):- Amino acids,- Botanical extracts <strong>and</strong> their derivatives,- Chelating agents,- Electrolyte <strong>and</strong> fluid replacement,- Enzymes, digestive <strong>and</strong> proteolytic preparations,- Homeopathic preparations,- Bioidentical hormones,- Gl<strong>and</strong>ular <strong>and</strong> organ preparations,- Minerals, trace minerals <strong>and</strong> their derivatives, <strong>and</strong>- Vitamins <strong>and</strong> vitamin preparations <strong>and</strong> derivatives.- A member may prescribe the following classes of drugs:- Anti-infectives: antibiotics, antifungals, antiparasitics,antivirals,- Skin <strong>and</strong> mucous membrane agents,- CSN agents: analgesics <strong>and</strong> antipyeretics: NSAIDs.- A member may only prescribe, dispense, sell, compound or usethose prescription therapeutic products <strong>and</strong> drugs within theclasses designated in the foregoing sections that are listed in theDrug List <strong>and</strong> must prescribe, dispense, sell, compound or usethose listed prescription therapeutic products <strong>and</strong> drugs inHPRAC Critical Links January 2009
