89Chapter 4 - Critical Links: Proposals for ImplementationThis chapter provides an overview of what Ontario’s laws might look like ifHPRAC’s recommendations are adopted to create a new Council on <strong>Health</strong><strong>Professions</strong> Regulatory Excellence (CHPRE), along with a new drugapprovals framework <strong>and</strong> process for health professions.To implement HPRAC’s recommendations in these areas, the followingchanges to statutes <strong>and</strong> regulations are proposed:Establishment of a New Agency to Facilitate <strong>and</strong> SupportInterprofessional Collaboration <strong>and</strong> Best Practices at the RegulatoryLevel <strong>and</strong> to Establish a New Drug Approvals Framework1. That the definition of “Advisory Council” in section 1(1) of the Regulated<strong>Health</strong> <strong>Professions</strong> Act, 1991 be repealed <strong>and</strong> the following substituted:“Agency” means Council for <strong>Health</strong> <strong>Professions</strong> Regulatory Excellence;2. That all references to “Advisory Council” in the Regulated <strong>Health</strong><strong>Professions</strong> Act, 1991 be replaced with references to “Agency”.That section 1(1) of the Regulated <strong>Health</strong> <strong>Professions</strong> Act, 1991be amended by adding the following definitions:“drug” means a drug as defined in the Drug <strong>and</strong> Pharmacies RegulationAct <strong>and</strong> includes prescription therapeutic products as defined in theFood <strong>and</strong> Drugs Act or the regulations made thereunder;“Drug List” means, for each health profession that has the authority toperform the controlled act of administering a substance by injection orinhalation, or prescribing, compounding, dispensing or selling drugsduring the course of practice of the profession, other than medicine ordentistry, the list of individual drugs that are designated by the Agencyas falling within a class of drugs authorized to the health professionby the regulations made under the health profession Act;“Formulary Committee” means the Drug <strong>and</strong> Therapeutics FormularyCommittee.3. That section 6 of the Regulated <strong>Health</strong> <strong>Professions</strong> Act, 1991 be repealed<strong>and</strong> the following substituted:Annual report6.(1) Each College shall report annually to the Minister on its activities<strong>and</strong> financial affairs.Audited financial statement(2) Each College’s annual report shall include an audited financialstatement.HPRAC Critical Links January 2009
