453Chapter 18 – Summary of Proposals for Implementation3. That the Physiotherapy Act, 1991 be amended by adding the followingsections:Additional requirements for authorized acts4.1 A member shall perform a procedure under the authority ofparagraph 1, 2, 4, 6 or 7 of section 4 in accordance with anyrequirements prescribed in the regulations made under this Act orunder the Regulated <strong>Health</strong> <strong>Professions</strong> Act, 1991.4.2 A member shall not perform a procedure under the authority ofparagraph 4 of section 4 unless the procedure is ordered, or theoxygen, drug or substance is prescribed, by a member of a Collegeas defined in the Regulated <strong>Health</strong> <strong>Professions</strong> Act, 1991 who has theauthority to make the order or prescription.Individual scope of practice for physiotherapists4.3 A member is responsible for identifying the limits of his or hereducational preparation <strong>and</strong> competencies, <strong>and</strong> for resolvingsituations beyond his or her expertise by consulting with orreferring patients to other health care professionals.4. That the Physiotherapy Act, 1991 be amended by adding the followingsection:Regulations11(b) Subject to the approval of the Lieutenant Governor in Council<strong>and</strong> with prior review by the Minister, the Council may makeregulations:(i) specifying requirements for the performance of proceduresunder the authority of paragraph 1, 2, 4, 6 or 7 of section 4; <strong>and</strong>(ii) prescribing the forms of energy that a member may order forthe purpose of paragraph 7 of section 4 of the Act <strong>and</strong> prescribingthe purpose for which, or the circumstances in which, the form ofenergy may be ordered.5. That Ontario Regulation 532/98 under the Physiotherapy Act, 1991(General) be amended by adding the following:6(6) It is a term, condition <strong>and</strong> limitation of a certificate ofregistration of any class that the holder who performs a procedureunder the authority of paragraph 1, 2, 6 or 7 of section 4 must: (a)provide satisfactory evidence of successful completion of a postgraduateprogram that meets approved criteria; <strong>and</strong> (b) ensure theprocedure performed does not exceed the level of trainingcompleted.(7) It is a term, condition <strong>and</strong> limitation of a certificate ofregistration of any class that the holder who performs a procedureHPRAC Critical Links January 2009
