principle in <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>health</strong> area<br />
11.6 The sub-committee’s c<strong>on</strong>clusi<strong>on</strong>s <strong>and</strong> recommendati<strong>on</strong>s<br />
c<strong>on</strong>cerning <str<strong>on</strong>g>the</str<strong>on</strong>g> precauti<strong>on</strong>ary principle<br />
The sub-committee has operated with two different approaches to <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
precauti<strong>on</strong>ary principle – a risk assessment approach <strong>and</strong> a zero value<br />
approach.<br />
Use of <str<strong>on</strong>g>the</str<strong>on</strong>g> risk assessment approach can imply a "c<strong>on</strong>servative" (=<br />
"cautious") assessment based <strong>on</strong> c<strong>on</strong>crete empirical evidence, whereas<br />
<str<strong>on</strong>g>the</str<strong>on</strong>g> zero value approach can be based <strong>on</strong> initially value-determined<br />
quality requirements that may <strong>on</strong>ly be deviated <str<strong>on</strong>g>from</str<strong>on</strong>g> after an assessment<br />
based <strong>on</strong> definable protecti<strong>on</strong> requirements.<br />
If <str<strong>on</strong>g>the</str<strong>on</strong>g> risk assessment approach can be based <strong>on</strong> sufficient scientific data<br />
to ensure complete protecti<strong>on</strong> of <strong>health</strong> <strong>and</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> envir<strong>on</strong>ment, <str<strong>on</strong>g>the</str<strong>on</strong>g> use of<br />
uncertainty factors can be said to be a satisfactory implementati<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
precauti<strong>on</strong>ary principle. Such an approach would thus mean that <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
precauti<strong>on</strong>ary principle did not add anything to <str<strong>on</strong>g>the</str<strong>on</strong>g> traditi<strong>on</strong>al risk<br />
assessment based <strong>on</strong> existing knowledge. However, <str<strong>on</strong>g>the</str<strong>on</strong>g>re are still<br />
unsolved questi<strong>on</strong>s about <str<strong>on</strong>g>the</str<strong>on</strong>g> possible inadequacy of uncertainty factors<br />
<strong>and</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> general questi<strong>on</strong>s c<strong>on</strong>cerning uncertainties due to lack of<br />
knowledge or indeterminacy related to <str<strong>on</strong>g>the</str<strong>on</strong>g> role of pesticides in society.<br />
The sub-committee has specifically examined possible applicati<strong>on</strong>s of<br />
<str<strong>on</strong>g>the</str<strong>on</strong>g> precauti<strong>on</strong>ary principle bey<strong>on</strong>d <str<strong>on</strong>g>the</str<strong>on</strong>g> existing authorisati<strong>on</strong> scheme,<br />
which can be described as a scientifically based risk assessment.<br />
The sub-committee has discussed whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r <str<strong>on</strong>g>the</str<strong>on</strong>g> zero value approach could<br />
be used within an authorisati<strong>on</strong> scheme for pesticides – in <str<strong>on</strong>g>the</str<strong>on</strong>g> following<br />
areas, for example – if it were found desirable to use this approach in <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
<strong>health</strong> area.<br />
1. Reducti<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> limit value for pesticide residues in food products to<br />
<str<strong>on</strong>g>the</str<strong>on</strong>g> lowest detecti<strong>on</strong> limit applying at any time.<br />
2. Reducti<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> limit value for pesticides in groundwater to <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
lowest possible detecti<strong>on</strong> limit at any time or authorisati<strong>on</strong> <strong>on</strong>ly of<br />
pesticides that meet requirements c<strong>on</strong>cerning zero mobility or <strong>on</strong>ly<br />
negligible mobility in soil.<br />
3. No authorisati<strong>on</strong> of substances classified as carcinogenic in cat3,<br />
mutagenic in cat3 or reproductive effect in cat3.<br />
4. Wider powers to impose restricti<strong>on</strong>s <strong>on</strong> use with a view to avoiding<br />
direct applicati<strong>on</strong> <strong>on</strong> crops, trees <strong>and</strong> bushes in <str<strong>on</strong>g>the</str<strong>on</strong>g>ir seed- <strong>and</strong> fruit<strong>and</strong><br />
berry-bearing periods. Treatment after <str<strong>on</strong>g>the</str<strong>on</strong>g>se periods implies direct<br />
applicati<strong>on</strong> of chemicals to what will be <str<strong>on</strong>g>the</str<strong>on</strong>g> edible crop. Spraying<br />
practice should thus be changed with a view to reducing <str<strong>on</strong>g>the</str<strong>on</strong>g> residual<br />
c<strong>on</strong>tents found today to below <str<strong>on</strong>g>the</str<strong>on</strong>g> detecti<strong>on</strong> limit. In o<str<strong>on</strong>g>the</str<strong>on</strong>g>r words, <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
precauti<strong>on</strong>ary principle should be applied as it is in <str<strong>on</strong>g>the</str<strong>on</strong>g> case of <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
limit for drinking water.<br />
It must be stressed that <str<strong>on</strong>g>the</str<strong>on</strong>g> sub-committee has not carried out an<br />
assessment of whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r <str<strong>on</strong>g>the</str<strong>on</strong>g> zero value approach should be used for <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
above-menti<strong>on</strong>ed examples, since that would require a dialogue between<br />
<str<strong>on</strong>g>the</str<strong>on</strong>g> following players:<br />
