20.3 E NVIRONMENTAL A SSESSMENT AND P ERMITTING<br />

Mining development projects similar to the <strong>Project</strong> are assessed and permitting in<br />

two phases. First, an EA is usually <strong>com</strong>pleted; then, projects proceed to the<br />

licensing phase (regulatory).<br />

20.3.1 ENVIRONMENTAL A SSESSMENT<br />

EAs in Yukon are administered by the YESAB, as governed by the YESAA. The EA<br />

process is a single-assessment process that applies throughout Yukon, to all<br />

projects, and to federal, territorial, and First Nations governments. Quartz mining<br />

projects conducted anywhere other than on an indian reserve are subject to an EA.<br />

Even though a portion of <strong>Project</strong> is located on Category B land owned by the Kluane<br />

First Nation, permits may be granted pursuant to the Quartz Mining Act (QMA) for<br />

persons holding a right, title or interest on the land prior to the time the area was<br />

claimed as Settlement Land, in 2003 (Minister of Public Works and Government<br />

Services Canada 2003) (Section 20.5.1). The <strong>Project</strong> will be subject to an EA under<br />

the YESAA. The Property falls within the southwest assessment district (YESAB<br />

2011).<br />

The <strong>Project</strong> requires an Executive Committee screening because it is a quartz<br />

exploration program that involves the movement of 250,000 t or more of rock.<br />

<strong>Project</strong>s assessed by the Executive Committee of YESAB generally require between<br />

one and three years (not more than 918 days, including time required for a<br />

government decision).<br />

Detailed information requirements for this process are outlined in the Information<br />

Requirements for Executive Committee <strong>Project</strong> Proposal Submissions under the<br />

YESAA, which is available through the YESAB office.<br />

Once assessments are <strong>com</strong>plete, re<strong>com</strong>mendations are forwarded to a decision<br />

body or bodies. The re<strong>com</strong>mendations will be one of the following (YSEBA 2011):<br />

• The <strong>Project</strong> will not have significant adverse effects and should proceed.<br />

• The <strong>Project</strong> will have significant adverse effects that cannot be mitigated and<br />

should not proceed.<br />

• The <strong>Project</strong> should proceed with terms and conditions that will mitigate the<br />

effects.<br />

• The <strong>Project</strong> should be assessed at a higher level. (Note: This can only<br />

occur when the assessment was done at the Designated Office (DO) or<br />

Executive Committee level.)<br />

In some cases, assessments may also re<strong>com</strong>mend project audits or effects<br />

monitoring.<br />
