20.3.2 LICENSING<br />

The <strong>Project</strong> will be subject to territorial legislation, and will require a number of<br />

permits and approvals (Table 20.1). The <strong>Project</strong> may also be subject to federal<br />

legislation, depending upon the specific project characteristics.<br />

TERRITORIAL<br />

Quartz Mine License<br />

In Yukon, all hard rock mining claims are administered through the QMA. The QMA<br />

enables the Government of Yukon to issue licenses and regulate mining<br />

developments, from design through to construction, operation, reclamation,<br />

de<strong>com</strong>missioning, and finally to closure. The Quartz Mine License (QML) is<br />

administered by the Government of Yukon Department of Energy, Mines, and<br />

Resources (Table 20.1). Proposed quartz mines require an assessment under the<br />

YESAA (Section 20.3.1); a mine license cannot be issued prior to an assessment<br />

(Figure 20.9). Although permits and licenses cannot be issued in advance of<br />

<strong>com</strong>pleting the assessment, regulatory processes can be initiated simultaneously<br />

while the assessment is underway (Yukon Energy, Mines, and Resources 2010).<br />

Even though a portion of <strong>Project</strong> is located on Category B land owned by the Kluane<br />

First Nation, permits may be granted pursuant to the QMA for persons holding a<br />

right, title or interest on the land prior to the time the area was claimed as Settlement<br />

Land, in 2003 (Minister of Public Works and Government Services Canada 2003)<br />

(Section 20.5.1).<br />

The licensing process is initiated by the submission of a letter of intent from the<br />

proponent requesting a license. Proponents are also required to submit various<br />

plans outlining the detail needed to understand the functionality and feasibility of the<br />

proposed development. These plans depend on the stage of project development,<br />

and can be described in two categories (Yukon Energy, Mines, and Resources 2010)<br />

(Figure 20.6):<br />

• mine development (provides proponents with permission to proceed with<br />

initial site construction activities that do not require a water licence)<br />

general site plan<br />

reclamation and closure plan<br />

• mine construction and operation (enables proponents to proceed with mine<br />

construction and operation after a water license is issued)<br />

project specific mine plans<br />

environmental protection plans.<br />
