Water License<br />

Under the Yukon Waters Act, the Yukon Water Board is responsible for licensing the<br />

use of water and the discharge of wastes into waters within the Yukon Territory<br />

(Yukon Water Board 2006). The <strong>Project</strong> will require a Type A license since the<br />

milling rate is anticipated to exceed the 100 t or more requirement of a Type A<br />

license. As with the QML, the Yukon Water Board cannot issue a water license if the<br />

issuance of the license is contrary to the YESAA decision (Yukon Water Board 2006)<br />

(Figure 20.6).<br />

Storage Tank Systems Permit<br />

In Yukon, all storage of fuel; such as diesel and gasoline, is regulated under the<br />

Storage Tank Regulation of the Yukon Environment Act. All storage tanks for<br />

activities, such as storage of diesel as a power source and heavy equipment require<br />

a Storage Tank System Permit and must be installed according to territorial and<br />

nation standards. An assessement under YESAA may be required for the storage<br />

tank proposal and will require additional information, such as a specific spill response<br />

plan. A pre-permit inspection of the storage tanks may be required prior to approval<br />

of the permit.<br />

FEDERAL<br />

Fisheries Act<br />

Fisheries and Oceans Canada (DFO) is responsible for protecting fish and fish<br />

habitat in Canada under section 35(1) of the federal Fisheries Act (DFO 2002).<br />

If an authorization is required it can take anywhere from one month to several years<br />

to obtain, depending on the type of approval required, the <strong>com</strong>plexity of the <strong>Project</strong>,<br />

and any associated field studies. <strong>Project</strong> activities, such as construction of crossing<br />

structures (e.g., culverts) or any work in or about a watercourse, will require an<br />

authorization under the Fisheries Act if they result in a harmful alteration, disruption<br />

and destruction (HADD).<br />

Habitat <strong>com</strong>pensation is an option for achieving no net loss when residual impacts of<br />

projects on habitat productive capacity are deemed harmful after relocation,<br />

redesign, or mitigation options have been implemented. Habitat <strong>com</strong>pensation<br />

involves replacing the lost fish habitat with newly created habitat or improving the<br />

productive capacity of some other natural habitat. Depending on the nature and<br />

scope of the <strong>com</strong>pensatory works, habitat <strong>com</strong>pensation may require, but not be<br />

limited to, five years of post-construction monitoring (DFO 2002).<br />

Navigable Waters Protection Act<br />

In general, navigable waters include all bodies of water that are capable of being<br />

navigated by any type of floating vessel for transportation, recreation or <strong>com</strong>merce<br />
