plan should include the establishment of thresholds and identified adaptive<br />

management responses should such thresholds be reached.<br />

20.5 S OCIAL C ONSIDERATIONS<br />

This section of the PEA:<br />

• identifies aboriginal and non-aboriginal <strong>com</strong>munities that may potentially be<br />

affected by the development of the <strong>Project</strong><br />

• identifies potential positive and adverse effects of the <strong>Project</strong> on local First<br />

Nations and other <strong>com</strong>munities<br />

• advises on further study requirements.<br />

20.5.1 PROJECT L OCATION AND FIRST NATIONS<br />

The Property is located partial on Category B land (R-49 B) and slightly overlaps<br />

Category A (R-01A) land owned by the Kluane First Nation (Figure 20.10) (Minister<br />

of Public Works and Government Services Canada 2003). As of the signing of the<br />

Kluane First Nation Final Agreement, on Category A land the First Nation holds both<br />

the surface rights and the subsurface/mineral rights, while on Category B land the<br />

Kluane First Nation owns the surface rights to this land, but not to that which is below<br />

the surface. However, land belonging to persons holding a right, title, interest,<br />

licence, and permit on the land prior to the time the area was claimed as Settlement<br />

Land are not applicable to this legislation (Minister of Public Works and Government<br />

Services Canada 2003).<br />

Surface Rights Legislation for Yukon First Nations is provided under the Umbrella<br />

Final Agreement between the Government of Canada, Government of Yukon, and<br />

Yukon First Nations. This legislation provides a mechanism to resolve disputes over<br />

access rights (Mining Yukon 2011 and Minister of Public Works and Government<br />

Services Canada 2003).<br />

The Kluane First Nation has a settled land claim, which provides them with access,<br />

rights and obligations to land and resources, and the right to govern their own affairs.<br />

The Kluane First Nation signed final and self-government agreements with the Yukon<br />

and Canadian governments on October 18, 2003. The effective date of these<br />

agreements was February 2, 2004 (Yukon ECO 2011a).<br />

The White River First Nation finalized negotiations toward final and self-government<br />

agreements with the Canadian and Yukon governments in 2002, when a<br />

Memorandum of Understanding was signed signifying the <strong>com</strong>pletion of the<br />

negotiation process. However, the White River First Nation decided not to ratify the<br />

negotiated agreements and there have been no negotiations since. As such, the<br />

White River First Nation does not have a settled land claim. Under the terms of the<br />
