ADMINISTRATIVE VIGILANCE DIVISION<br />
6.3.1 In exercise of the powers conferred by clause(b) of sub-section (2) of Section 8 of<br />
the Central Vigilance Commission Act, 2003 (45 of 2003), the Government has<br />
notified, vide Notification No.418/2/2004 dated 12 September, 2007, the level of<br />
officers of the corporations established by or under any central act, the government<br />
companies, societies and other local authorities owned or controlled by the central<br />
government for the purpose of clause (D) of sub section (1) of Section 8 of the Act.<br />
6.3.2 In exercise of the powers conferred by Section 20 of the Central Vigilance<br />
Commission Act, 2003 (45 of 2003) and in supersession of the Central Vigilance<br />
Commission (Staff) Rules, 1964, the Government has notified the Central Vigilance<br />
Commission (Staff) Rules, 2007, vide Notification No.418/4/2003-AVD-IV dated 8<br />
November, 2007.<br />
6.3.3 Department of Personnel and Training also handles all policy and administrative<br />
matter pertaining to the Central Vigilance Commission and is responsible for laying<br />
Annual Report of the Central Vigilance Commission before each House of<br />
Parliament. The Annual Report of the Central Vigilance Commission for the year<br />
2007 has been laid on the Table of both the Houses in December 2008.<br />
6.3.4 As per the annual report of the CVC, major penalty was awarded in 3526 cases<br />
and minor penalties in 4770 cases. As against 3526 cases, major penalties viz<br />
dismissal, removal and compulsory retirement from service were imposed on 827<br />
officers from various organizations. In pursuance of the Commission’s advice, the<br />
competent authorities in various organization issued sanction for prosecution against<br />
192 public servants. The percentage of the cases where punishments were awarded,<br />
to the number of cases received in the Commission, worked out to more then<br />
55per cent.<br />
6.3.5 The Central Vigilance Commission in its endeavor to fulfil its obligations as an<br />
agency to ensure transparency and accountability in Public Administration has been<br />
emphasizing the use of technology. The Commission has given directions to all<br />
government organizations, making it compulsory for them to provide detailed<br />
information regarding the rules and procedures governing issue of licenses,<br />
permission etc. on their websites. All the application forms and proformas should<br />
be made available on the websites in a downloadable form. The Commission has<br />
also reiterated its instructions to all organizations to post a summary of all awarded<br />
