RESERVATION IN THE CENTRAL GOVERNMENT SERVICES<br />
7. The Government has taken several steps for the upliftment and welfare of the<br />
Scheduled Castes, the Scheduled Tribes, the Other Backward Classes and the<br />
Persons with Disabilities. One of such steps is to give them reservation in services<br />
under the State. The ex-servicemen are also getting reservation in services.<br />
RESERVATION FOR SCS, STS AND OBCS<br />
Constitutional Provisions<br />
7.1 Clause (4) of Article 16 of the Constitution of India enables the State to make<br />
provision for the reservation of appointments or posts in favour of any backward<br />
class of citizens which, in the opinion of the State, is not adequately represented in<br />
the services under the State. Clause (4A) of the same article enables the State to<br />
provide reservation for the members of the Scheduled Castes (SCs) and Scheduled<br />
Tribes (STs) in the matter of promotion. Article 335 declares that the claims of the<br />
members of the Scheduled Castes and the Scheduled Tribes shall be taken into<br />
consideration, consistently with the maintenance of efficiency of administration in<br />
the making of appointments to services and posts in connection with the affairs of<br />
the Union or of a State. Proviso to the said article empowers the State to make any<br />
provision in favour of the members of the Scheduled Castes and Scheduled Tribes<br />
for relaxation in qualifying marks in any examination or lowering the standards of<br />
evaluation, for reservation in matters of promotion to any class or classes of services<br />
or posts in connection with the affairs of the Union or of a State. Armed with the<br />
powers given by these provisions of the Constitution, the Government has issued<br />
various instructions providing for reservation in services for the members of the<br />
Scheduled Castes (SCs), the Scheduled Tribes (STs) and the Other Backward<br />
Classes (OBCs).<br />
Reservation In Direct Recruitment<br />
7.1.1 Reservation for SCs, STs and OBCs is available in all groups of posts in case of<br />
direct recruitment. While in case of direct recruitment on all India basis by open<br />
competition, reservation for SCs, STs and OBCs is respectively 15per cent, 7.5per<br />
cent and 27per cent, in case of direct recruitment on all India basis. In others by<br />
