Chapter 3 Land Use and Development/Reuse Regulations<br />

based on the parking demand analysis completed for anticipated<br />

development <strong>of</strong> this area as described in the <strong>Tustin</strong> Legacy<br />

Community Core Mixed Use Development – Phases I & II Shared<br />

Parking Study dated January 2006 (“Community Core Shared<br />

Parking Study”), as may be amended subject to review and approval<br />

by the Public Works Department.<br />

The parking reductions authorized under this Subsection 3.13.4 shall<br />

not limit nor preclude use <strong>of</strong> the shared parking provisions allowed<br />

under Subsection 3.13.1. C., Joint Use <strong>of</strong> Parking Areas.<br />

C. Assumptions<br />

1. Parking provided for residential units and residential guests will<br />

not be available for shared uses and shall be reserved for<br />

residents and guests only. Residential parking spaces shall not be<br />

included in any authorized parking reduction pursuant to this<br />

Subsection 3.13.4.<br />

2. No reduction <strong>of</strong> parking shall be taken for patrons using multiple<br />

facilities (i.e., captive ratio).<br />

3. The demand ratios for the weekday and weekend parking are<br />

based on recommendations and data collected by Urban Land<br />

Institute (ULI) and Shared Parking Guidelines prepared by ITE<br />

(Institute <strong>of</strong> Transportation Engineers).<br />

D. Requirements. The Community Development Department shall<br />

only conditionally approve a 20% reduction in parking provided that<br />

the following findings and/or conditions are met:<br />

1. A determination <strong>of</strong> consistency with the general mix <strong>of</strong> land uses<br />

shall be made, based upon the anticipated development<br />

programming used in the Community Core Shared Parking<br />

Study, on file at the Community Development Department.<br />

2. The minimum number <strong>of</strong> parking spaces against which the 20%<br />

parking reduction may be applied shall be determined based on<br />

the number <strong>of</strong> parking spaces that would otherwise be required<br />

for each land use separately as identified in Section 3.13.5.<br />

3. Shared parking spaces shall be so located so they will adequately<br />

serve the uses for which they are intended.<br />

4. If privately owned parking is to serve two or more separate<br />

properties, a written and recorded agreement between property<br />

owners approved by the <strong>City</strong> Attorney and Community<br />

Development Department shall be executed between property<br />

owners or properties guaranteeing access to, use <strong>of</strong>, and<br />

management <strong>of</strong> designated spaces.<br />
