Chapter 4 • Specific <strong>Plan</strong> Administration<br />

Site <strong>Plan</strong> and Design Review projects shall be submitted to the<br />

Community Development Department on application forms provided by<br />

that Department.<br />

4.2.5 Variances and Conditional Use Permits<br />

All applications shall be processed in accordance with the <strong>Tustin</strong> <strong>City</strong><br />

Code or the Irvine <strong>City</strong> Code, as applicable.<br />

4.2.6 Minor Modifications<br />

Minor modifications consist <strong>of</strong>: 1) limited deviations from specified site<br />

development standards; 2) refinements in Specific <strong>Plan</strong> language which<br />

increase clarity and do not change the Specific <strong>Plan</strong> policy intent; and 3)<br />

correction <strong>of</strong> conflicting or confusing language or inadvertent errors in the<br />

originally approved plan and which do not change the Specific <strong>Plan</strong> policy<br />

intent. Requests for minor modifications shall be processed in accordance<br />

with the <strong>Tustin</strong> <strong>City</strong> Code, unless otherwise addressed in Subsection 4.2.5,<br />

Responsibility or the Irvine <strong>City</strong> Code, as applicable.<br />

Within the <strong>City</strong> <strong>of</strong> <strong>Tustin</strong>, minor modifications may be requested for the<br />

following:<br />

A. Building site area decrease - up to 5 percent;<br />

B. Building/landscape setback decrease - up to 10 percent;<br />

C. Height <strong>of</strong> fence or wall increase - up to 20 percent;<br />

D. Projections into required setbacks increase - up to 10 percent;<br />

E. Building height increase - up to 10 percent;<br />

F. Reduction in <strong>of</strong>f street parking spaces for non-residential uses - up<br />

to 10 percent;<br />

G. Decrease in distance between buildings - up to 10 percent; and<br />

H. Modifications <strong>of</strong> previously required conditions.<br />

4.2.7 Interim Use Permits<br />

A. Definition <strong>of</strong> Interim Use<br />

The purpose for which a parcel <strong>of</strong> land or a structure is or may be<br />

intended, designed, arranged, constructed, erected, occupied, leased,<br />

maintained, altered, moved and/or enlarged for a limited period <strong>of</strong> time in<br />

excess <strong>of</strong> six months and not to exceed 5 years from the date <strong>of</strong> the interim<br />

lease, in lieu <strong>of</strong> a permanent use in accordance with this Specific <strong>Plan</strong> 51 .<br />
